On January 5, 2025, the girlfriend of Chinese actor Wang Xing posted on social media that he had gone missing in Thailand, sparking widespread discussion; by January 7, it was confirmed that Wang Xing had been found. According to media reports, during the rescue operation for Wang Xing, two detention sites were identified. At the first site, 10 Chinese nationals were found, and at the second site, 50 Chinese nationals were discovered, where actor Wang Xing was also located and rescued.
The disappearance of actor Wang Xing on the Thai–Myanmar border has once again drawn attention to transnational telecom fraud crimes. These criminal groups are expanding rapidly and operating on a massive scale, with an increasing number of Chinese citizens being lured to Southeast Asian countries under various deceptive pretexts and forced to engage in telecom fraud activities. Chinese citizens in Southeast Asia are derisively referred to as “pigs” or even “walking yuan”; according to the confessions of apprehended suspects, a Chinese person can be sold locally in Southeast Asia for twenty to thirty thousand yuan, and ultimately resold for three to four hundred thousand yuan per person, being treated as a commodity in various industrial parks—this gravely infringes upon the lives, property, and legitimate rights and interests of our people.

In accordance with the provisions of China’s laws and regulations, any individual who, within a one-year period, accumulates more than 30 days of stay in overseas criminal hubs or makes multiple trips to such hubs shall be deemed to fall under the “other serious circumstances” as stipulated in Article 266 of the Criminal Law and shall be prosecuted for the crime of fraud in accordance with the law. Whoever defrauds public or private property in a relatively large amount shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, or control, and shall be fined or subjected to a fine only; if the amount is huge or other serious circumstances exist, the offender shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years, and shall be fined.
Therefore, members of overseas telecom fraud criminal groups—i.e., suspects in domestic telecom fraud cases—who have remained with the group for 30 days or have repeatedly returned to it may be found guilty of fraud. Moreover, even after enduring both psychological and physical abuse abroad, they will still face legal accountability upon returning to China.
Based on the author’s personal experience handling Southeast Asian telecommunications fraud cases, and in light of the Wang Xing missing-person incident in northern Myanmar, this paper summarizes key points to be aware of regarding overseas telecommunications fraud rings.
1
Overview of Overseas Telecommunications and Cyber Fraud Cases
According to data from the National Procurators-General Conference held in Beijing on January 13, 2025, from January to November 2024, procuratorial organs prosecuted 67,000 individuals for telecommunications and internet fraud, an increase of 58.5% year on year.
Increasingly, sophisticated and personalized scams are being crafted to target individuals across all industries and with diverse needs. These schemes vary in their claims, purporting to offer high-paying, low-stress jobs for purposes such as game promotion, financial investment, service advertising, or currency exchange and money transfers. After embarking on the journey, all relevant personnel are subjected to practices similar to those in the Wang Xing incident: passports and mobile phones are confiscated; accommodation and meals are centrally managed; personal freedom is deprived, and individuals endure physical confinement, as well as both physical and psychological oppression.
Based on past case experience, most individuals suspected of involvement in overseas telecommunications fraud initially do not realize they are engaged in criminal activities; by the time they become aware of this, they have already lost their personal freedom or face unaffordable breach-of-contract penalties, and may even endure physical abuse and psychological harassment, making it impossible for them to escape.
Two
Learn from past experiences and prevent telecom fraud before it happens.
Most individuals suspected of involvement in overseas telecommunications fraud are lured to work for companies in Southeast Asia with the promise of substantial earnings. Both offline presentations and online promotions are included:
In offline settings,The majority of defendants involved in cross-border telecommunications fraud reported that they were recruited through introductions by relatives or friends. Fraud rings typically exploit trust by leveraging existing members to promote their schemes within their personal networks, enticing relatives and friends with promises of high salaries and a relaxed work environment in Southeast Asia.
During the recruitment process, they conceal the true nature of the work and blur its occupational profile, using job descriptions such as “game promotion” or “customer service chat” to mask the criminal essence of telecom fraud.

Defendant X
A distant relative of mine told me he works in Southeast Asia and can earn a lot of money every month. At the time, he didn’t specify what the job entailed; he offered us a base salary of 6,000 yuan per month, with increments of 1,000 yuan until it capped at 8,000 yuan.
At the time, I was tricked into going there by my cousin-in-law. He told me there were high-paying office jobs in Cambodia, so I agreed and went to Cambodia to work. They arranged my flight for me, and I’ve already sent them photos of my ID card and passport.
Defendant Y
My brother-in-law recommended that I take a job at a company in Cambodia. It’s an office position with a salary of over 10,000 yuan; the work mainly involves typing and chatting. After hearing that, I agreed.
The defendant L
When I was working in Guangdong, I met a friend whose name I can’t quite remember. He told me that one of his friends works overseas, primarily doing typing and chatting, with a fixed monthly salary of 20,000 yuan. He asked me if I wanted to go with him.
Online,Criminal groups use social media platforms to lure victims: They exploit social media and job‑posting websites to disseminate false information, disguising their telecom fraud schemes behind seemingly legitimate job titles such as “Cross‑Border E‑Commerce Customer Service Representative” or “Overseas Cryptocurrency Trader.” In the job description, the emphasis is on a relaxed workload and high compensation, while the job requirements are stated rather vaguely.

Defendant C
My wife met an online friend named Wang who invited her to work in Southeast Asia. At the time, I was worried about her going alone, so I asked her to check with him whether I could go with her. He said it was fine for both of us to go together.

There are six people in my dorm room. The company’s rules and regulations include: arriving and leaving on time; if you don’t meet your sales targets, you’ll be called in for a talk; and if you still fail to meet the targets after the talk, you’ll be penalized. I’ve heard that some people have even been beaten for not meeting their quotas.

When my wife and I got off the plane, the company staff took our passports and ID cards under the pretext of processing visas. After we realized they were using us for telecom fraud, we went to the company to ask for them back, but they refused, saying that since we had signed a contract, we had to work for six months before we could leave.
I don’t have a steady job, and I don’t have any money to spend. I just wanted to find a job through 58.com. On the website, I saw an ad recruiting office clerks for an overseas recruitment company—typing skills required—with a monthly base salary of 5,000 to 10,000 yuan. The ad also included a phone number, and the recruiter told us we’d be working in Southeast Asia.

The defendant M

Defendant D
While searching for a job online, I came across an opportunity to work as a game customer service representative at a Southeast Asian company. The salary ranges from 8,000 to 10,000 yuan, and the company covers the cost of round-trip airfare.
My brother was looking for a job online, and one day he told me he’d found a position in game promotion, with a base salary of 6,000 yuan and the company covering his travel expenses.

Defendant H
Since joining, the prolonged work pressure at a telecom fraud company may lead to psychological disorders such as anxiety and depression. At the same time, being subjected to intense daily work and threats from the fraud ring at the scam operation also places employees in a state of heightened physical and mental stress, causing harm to both their physical and psychological well-being.

Three
The defendant is also a victim—how can we provide relief to individuals trapped by overseas cyberfraud criminal groups?
The aforementioned individuals who have been compelled to engage in the telecommunications fraud industry are also victims. Drawing on my past experience in handling such cases and in accordance with the provisions of China’s current laws and regulations, I hereby offer the following recommendations for criminal suspects who have strayed onto this path and committed telecommunications fraud, with the aim of mitigating the impact and reducing the severity of punishment:
(I) Self-surrender and voluntary confession
The act of surrendering oneself to the authorities and truthfully confessing to one’s crimes constitutes voluntary surrender, which generally results in a lighter or reduced punishment.
A suspect in an overseas telecommunications fraud case voluntarily returned to China and turned themselves in, disclosing their primary criminal activities within the fraud ring, including the methods used to carry out the scams, the amounts involved, and information about the gang’s members. In light of the defendant’s voluntary confession and the value of the information provided, the sentence may be appropriately reduced from the original term that would otherwise have been imposed.
Article 67 of the Criminal Law of the People's Republic of China“After committing a crime, a person who voluntarily surrenders and truthfully confesses to their offense shall be deemed to have surrendered themselves. For criminal offenders who surrender themselves, the punishment may be mitigated or reduced; where the offense is relatively minor, punishment may be exempted.”
Article 13 of the “Opinions on Several Issues Concerning the Application of Law in Handling Criminal Cases Involving Cross-Border Telecommunications Network Fraud, etc.”“Individuals who commit cross-border telecommunications network fraud, extortion, or other such crimes and voluntarily return to China to surrender themselves, or do so after being persuaded by relatives or friends, and truthfully confess their crimes, shall be deemed to have surrendered themselves and may, in accordance with the law, be given a lighter or reduced punishment. In cases where the crime is relatively minor, they may be exempted from punishment.”
Guiding Opinions on Sentencing for Common Crimes (Trial Implementation)With regard to the circumstance of voluntary surrender, taking into account such factors as the motive for surrender, the timing, the manner of surrender, the severity of the offense, the extent to which the offender truthfully confessed to the crime, and the degree of remorse demonstrated, the base sentence may be reduced by less than 40 percent; where the offense is relatively minor, the base sentence may be reduced by more than 40 percent, or punishment may be waived in accordance with the law.
(II)The importance of providing relevant clues
The clues you have uncovered during the commission of the crime are crucial for dismantling the entire fraud ring’s criminal network and mapping out the complete organizational structure. Telecom fraud is often an organized criminal activity. The clues provided by the suspects regarding the division of labor, communication methods, and money transfer channels among gang members—such as details about the composition and workflows of specialized groups within the fraud ring, including the “information group” responsible for obtaining citizens’ personal information, the “call center group” conducting scripted scams, and the “funds group” handling money laundering—can be of great significance in mitigating their sentences.
Article 68 of the Criminal Law of the People's Republic of China“Where a criminal offender reveals another person’s criminal conduct that is verified as true, or provides important leads that lead to the solving of other cases, and thereby demonstrates meritorious service, he or she may be given a lighter or reduced punishment; if the meritorious service is of major significance, the punishment may be reduced or even exempted.”
Article 8 of the “Opinions on Several Specific Issues Concerning the Handling of Self-Surrender and Meritorious Service”“As regards the punishment of defendants who have surrendered themselves or made meritorious contributions: where such circumstances exist, the punishment shall generally be mitigated or reduced in accordance with the law; where the circumstances of the crime are relatively minor, punishment may be exempted.”
(III) The role of collecting evidence of coercion
In some cross-border telecommunications fraud cases, certain individuals have participated in fraudulent activities under duress. Collecting evidence of coercion is crucial for determining the subjective intent of a criminal suspect. For individuals who were coerced into participating in a crime, if it can be sufficiently proven that they were subjected to severe coercion and played only a secondary, auxiliary role in the commission of the offense, their legal liability will be markedly distinguished from that of principal offenders who actively and willingly participated, and they may receive a lighter sentence.
Article 28 of the Criminal Law of the People's Republic of China“With respect to those who are coerced into participating in a crime, their punishment shall be mitigated or exempted in accordance with the circumstances of their offense.”
Article 12 of the “Opinions on Several Issues Concerning the Application of Law in Handling Criminal Cases Involving Cross-Border Telecommunications Network Fraud, etc.”“If a criminal suspect or defendant claims to have been coerced abroad into committing telecommunications and internet fraud, extortion, or other criminal activities, the clues or materials they provide shall be investigated and verified, and a comprehensive determination shall be made as to whether they fall under the category of persons who were coerced into participating in a crime as stipulated in Article
28of the Criminal Law.”
(IV) Restitution and compensation
The restitution of ill‑gotten gains and compensation for losses serve to mitigate the economic harm caused to the victim by the criminal act, and constitute an important factor in assessing the defendant’s remorse. By taking concrete actions to redress their wrongdoing, defendants may have this considered as a significant mitigating circumstance during sentencing. In telecommunications fraud cases, the return of illicit proceeds and compensation to victims can help make amends for some of their losses.
Returning the illicit proceeds to the victims or the relevant financial institutions can mitigate the social harm caused by fraudulent activities and safeguard socio-economic order.
Guiding Opinions on Sentencing for Common Crimes (Trial Implementation)“With respect to the return of illicit proceeds or compensation for damages, taking into account the nature of the crime, the extent to which such acts mitigate the harm caused, the amount returned or compensated, and the degree of voluntariness, the base sentence may be reduced by less than 30%.”
Article 3 of the “Interpretation on Several Issues Concerning the Specific Application of Law in Handling Criminal Cases of Fraud”"(II): 'Although the fraud involving public or private property has reached the 'substantial amount' threshold stipulated in Article 1 of this Interpretation, if any of the following circumstances exist and the offender pleads guilty and shows remorse, prosecution may be refrained from or criminal punishment may be waived in accordance with Article 37 of the Criminal Law and Article 142 of the Criminal Procedure Law:... (II) Full restitution of the stolen goods and compensation are made before the first-instance judgment is pronounced.'"
Article 3 of the “Guidelines for People’s Procuratorates in Handling Telecommunications and Internet Fraud Cases”“Where the criminal suspect’s offense is relatively minor, the social dangerousness or the necessity of detention shall be assessed comprehensively, taking into account such factors as the suspect’s position and role within the criminal organization, the duration of their involvement, the nature of their duties, their attitude toward admitting guilt, their remorseful conduct, and the overall circumstances of the case, in accordance with the principle of consistency between subjective and objective elements.”
Where the criminal suspect sincerely admits guilt and expresses remorse, truthfully confesses, and maintains a consistent statement, the following circumstances may be considered to indicate a lower degree of social danger: 5. For an accomplice whose direct involvement in the fraud does not amount to a “huge” sum, and who actively returns the ill-gotten gains.
In this era of rapidly spreading information, overseas telecom fraud groups are constantly devising new schemes. We must remain highly vigilant at all times, proactively prepare for potential threats, and prioritize preventive measures.
For victims of overseas telecommunications fraud criminal groups—i.e., defendants in domestic fraud cases—through the implementation of professional defense strategies and based on the specific facts of each case, we strive to ensure accurate and objective legal determinations, thereby upholding the principle of equality before the law.
