Zhiheng Interpretation of Doubts. Life insurance claims in the police station "death certificate" of the offensive and defensive tactics research.

Abstract

ZHIHENG

In life insurance claim disputes, the “Death Certificate” issued by a police station, as an official document pursuant to Article 10 of the Supreme People’s Court’s Provisions on Several Issues Concerning Evidence in Civil Litigation, is accorded a high degree of presumptive evidentiary force in judicial practice. However, this presupposition is not beyond challenge.

This article aims to systematically expound the offensive and defensive tactics system of effectively cross-examination and counter-system of this kind of evidence from the perspective of lawyers' practice through legal analysis and case deconstruction. The core of the attacking side lies in dismantling the opposing party’s credibility through the strategies of “procedural legitimacy review” and “evidence base nullification”; while the essence of the defending side is to consolidate the integrity of its formal requirements and establish a system of corroborating evidence from multiple sources.

This article argues that precisely shifting the focus of litigation from the “dispute over substantive truth” to the “debate over procedural legality” is the key for the plaintiff to achieve a reversal in the case.

Raising the Issue--

The “Evidence Barrier” of Official Documents

In litigation concerning life insurance claims, the “death certificate” issued by the public security authorities and presented by the beneficiary often establishes a prominent evidentiary barrier at the very outset of the trial. According to the rules of evidence in civil litigation, parties are not required to provide proof for facts stated in official documents. From the very outset of their internal conviction, judges assign a very high evidentiary weight to it.

For insurers and their counsel, this presents a classic litigation dilemma: we are challenging not merely a piece of evidence, but also the presumptive credibility conferred upon it by public authority. Traditional methods of challenging evidence, such as merely questioning its content or emphasizing the need for expert authentication, often fail in the face of this presumption when no equally compelling counter-evidence is presented. Therefore, it is imperative to develop a more disruptive and systematic offensive–defensive strategy.

Two

Defense Base:

The defender’s (“beneficiary’s”) “fortress-building” tactic

The defending side’s core strategy lies in consolidating and leveraging the initial advantage afforded by this official document.

1. Strict adherence to formal requirements: Ensure that the supporting documents contain all necessary elements, including the official seal of the issuing authority, the signature and seal of the police officer, the date of issuance, clear textual descriptions, and explicit information identifying the deceased. Any formal defect is a point of attack for the opposing side.

2. Consistency of the evidentiary chain: Do not rely solely on this certificate; instead, link it with other evidence such as police reports, emergency medical service dispatch records, hospital admission records, and certificates issued by the village or neighborhood committee, so that they corroborate one another and form a preliminary evidentiary framework, thereby strengthening the overall probative force.

3. Maintaining the Litigation Position: During the trial, the defending party should consistently uphold the position that it has fulfilled its initial burden of proof, emphasizing that, pursuant to Article 22 of the Insurance Law, it has submitted all available supporting documentation and has successfully shifted the burden of proof to the insurer. The core argument is: “Our side has submitted official documents prepared by a state authority in accordance with its statutory powers; if the insurer seeks to challenge their validity, it must provide contrary evidence sufficient to rebut them.”

Three

Offensive Breakthrough:

The attacking side’s (insurer’s) “three-dimensional deconstruction” tactic

The attacking side’s objective is to systematically dismantle the foundation of public trust upon which this official documentary evidence relies. This tactical system can be divided into three progressive levels.

(I) First level: The spear of procedural legality—launching a "cut off at the root" attack.

This tactic aims to challenge the administrative act itself, thereby undermining the very foundation of its evidentiary admissibility.

Tactical Core: Break free from the entanglement of “substantive truth” in civil litigation, and instead challenge the legality of the evidence as an “administrative act.” Shift the battlefield from “what the facts are” to “how the evidence was produced.”

Attack path:

1. Challenge to the Principle of Statutory Authority: It is argued that a police station’s act of making a definitive determination regarding complex causes of death—particularly when diseases and accidents are intertwined—exceeds its statutory duties of maintaining public order and conducting preliminary investigations, and in substance amounts to the exercise of forensic expertise, a function that requires specialized qualifications.

2. Legitimacy of the investigative procedure: Question whether all necessary investigative procedures were duly followed prior to its issuance, such as on-site inspection, questioning of key witnesses, obtaining surveillance footage, and preparing standardized records. If the procedure is lacking, it may be argued that the evidence constitutes a “statement of circumstances” based on a superficial investigation, rather than a rigorous “expert opinion.”

Case law support: In case No. (2016) E 05 Xing Chu 36, although the court did not uphold the plaintiff’s claim, it clarified the boundaries within which administrative actions may be subject to judicial review, thereby creating a legal basis for challenging the procedural legality of such actions. The plaintiff may, on this basis, argue that the civil court should review the legality of the procedure by which the evidence was generated.

(II) Second level: Analysis of the evidence base—Implementing a “center bloom” style crackdown.

This tactic aims to expose the glaring contradictions between the alleged evidence and the objective facts, thereby rendering its claims self-defeating.

1. Tactical Core: Instead of directly refuting the conclusion, this approach exposes its absurdity and unreliability by presenting irrefutable objective evidence.

Attack path:

2. Medical record attack: Present the deceased’s complete medical records, clearly demonstrating that they suffered from severe underlying conditions—such as cardiovascular or cerebrovascular diseases—that could have led to sudden death. Question: “How can the conclusion of an ‘accidental drowning’ account for the ‘disease bomb’ that was already present in the deceased’s body?”

3. Temporal–spatial logical attack: If it can be demonstrated that the recorded time and place of death are in clear contradiction with mobile phone call records, surveillance footage, witness testimonies, and other evidence, this directly exposes the hasty nature of the factual findings.

4. Common-sense and experiential attack: By integrating on-site photographs, environmental evidence, and other relevant factors, apply rules of thumb to demonstrate the low probability of their “accidental” conclusion. For example, in extremely shallow water, the assertion of “drowning” may prompt the judge to make a determination based on common sense.

(III) The third level: the hammer of scientific evidence—achieving a "one-hit-kill" conclusion.

This is the most devastating tactic, designed to completely override or invalidate theEffectiveness of administrative certifications by invoking a higher level of evidentiary authority.

1. Tactical Core: Introduce forensic expert opinions to elevate the dispute to the level of scientific evidence.

2. Attack path: Apply for a court-appointed forensic examination, or independently engage a qualified forensic institution to conduct a documentary review of the deceased’s medical records and other relevant documents, and issue a professional expert opinion on the cause of death.

In court, a contrasting framework of “administrative certification versus scientific expert testimony” is established. At this point, the prosecution’s central argument shifts to: “Your Honor, when an administrative certificate based on a cursory investigation conflicts with a forensic expert opinion grounded in scientific testing principles, which should serve as the basis for the final judgment? Should we respect science, or blindly defer to the authority of an official seal?”

Four

Offense-Defense Transitions and Tactical Integration

A skilled litigator does not employ the aforementioned tactics in isolation; rather, they integrate them to create a dynamic interplay of offense and defense.

1. Attacking as a Defense: In civil litigation, the insurer (the attacking party) simultaneously initiates (or threatens to initiate) an administrative lawsuit against the public security authorities, alleging that their actions are unlawful. This could put pressure on the civil courts, shake the judge's inner confidence in the evidence, and may even prompt the court to suspend the trial and wait for the administrative dispute to be resolved before deciding.

2. Turning the tables: When faced with strong procedural challenges, the defending party (the beneficiary) should revert to the formal authenticity of the public document evidence, emphasizing that the insurer has not provided any evidence demonstrating that the document is “forged or altered.” Procedural defects do not necessarily render the content inaccurate, and the aim is to refocus the argument on the insurer’s substantive burden of proof.

Conclusion

In the life insurance claims dispute, the attack and defense of the "Death Certificate" of the police station is a complex game involving evidence law, administrative law and litigation skills. For insurers, the key to breaking the impasse lies in shifting their mindset from “passive questioning” to “proactive deconstruction.” By constructing a multi-dimensional tactical system that uses “procedural legality review” as the breakthrough, “evidence deconstruction” as the main offensive, and “scientific expertise” as the final means, it is entirely possible to dismantle the opposing party’s “evidentiary fortress.”

The ultimate lesson of this battle of arguments is that, in court, the most powerful weapon is not the mere denial of a conclusion, but the thorough deconstruction of the opposing party’s evidentiary reasoning. When the aura of an official document is stripped away by the spotlight of procedure and the scrutiny of scientific analysis, its so‑called “inviolability” reaches its end.
