Internet advertising series (2): advertising-oriented issues show a high level of concern, and seven compliance methodologies are mastered in one article
Author | Intellectual Property Center, Elephant Migration Team
The first part, advertising-oriented reality requires great attention
In February 2023, the State Administration for the Market announced the "Measures for the Administration of Internet Advertising", which systematically revised the original measures that have been in effect for more than six years. The revised provisions specifically added principled provisions on Internet advertising, requiring that "Internet advertising should... adhere to the correct orientation, express advertising content in a healthy form, and meet the requirements of socialist spiritual civilization construction and the promotion of Chinese excellent traditional culture." It also proposed to support and encourage "Internet public service advertising campaigns" to "spread socialist core values and Chinese excellent traditional culture, and advocate civilized customs."
The issue of advertising orientation was clearly included in the national department regulations for the first time, and it was emphasized. Since then, this provision has also become the highest level of advertising orientation content in our country's series of advertising laws, regulations and normative documents.
Laws, regulations and normative documents
"Internet Advertising Management Measures"
Article 3: Internet advertising shall be true, legal, adhere to the correct orientation, and express advertising content in a healthy form, in line with the requirements of socialist spiritual civilization construction and the promotion of Chinese excellent traditional culture.
Using the Internet to engage in advertising activities shall comply with laws and regulations, be honest and trustworthy, and compete fairly.
The state encourages and supports the development of Internet public service advertising campaigns, disseminates socialist core values and excellent traditional Chinese culture, and advocates civilized customs.
But our country's attention to advertising-oriented issues is nothing new.
From the perspective of national policy orientation, laws and regulations and supervision, the Advertising Law implemented in our country in 1995 clearly stated that "advertising content should be conducive to people's physical and mental health, promote the improvement of the quality of goods and services, protect the legitimate rights and interests of consumers, abide by social ethics and professional ethics, and safeguard the dignity and interests of the country."
In 2005, the former State Administration for Industry and Commerce (abolished) and other departments jointly issued the "Notice on Printing and Distributing the Work Plan for the Rectification of False and Illegal Advertisements", which clearly emphasized "strengthening the management of news media advertising orientation."
On February 19, 2016, at the Party's News and Public Opinion Work Symposium, the *** put forward the instruction that "advertising and publicity should also be oriented", emphasizing that "all aspects and links of news and public opinion work must adhere to the correct public opinion orientation." Party newspapers, party magazines, radio and television stations at all levels should be oriented, urban newspapers and new media should also be oriented; coverage should be oriented, supplements, special programs, advertising and publicity should also be oriented; current political news should be oriented, entertainment and social news should also be oriented; domestic coverage should be oriented, and international coverage should also be oriented "content [1].
Subsequent to this, the regulations and notification documents of key ministries and commissions related to Internet advertising have always been implemented *** the spirit of the important instructions on "advertising should also be oriented", repeatedly emphasizing the "correct orientation" of advertising.
Looking at the rectification of special projects such as false and illegal advertisements and Internet advertisements in recent years, the investigation and punishment of advertisements "involving guidance issues" has never stopped.
In February 2023, the State Administration for Market Regulation focused on exposing a number of typical cases of illegal advertising involving orientation, demonstrating a zero-tolerance attitude towards advertisements that "harm national dignity, hinder social stability, hinder social public order, and violate social good customs."
At the local level, the market supervision and management departments in Guangdong (Guangzhou, Shenzhen and other places), Beijing, Shanghai, Tianjin, Zhejiang, Chongqing, Fujian, ***********lin and other regions have successively issued notices and prompt documents to strengthen the review of advertising guidance, and strengthen the supervision of advertising-oriented issues. In the typical cases of annual and special project rectification announced by local market supervision and management departments, there is also no shortage of rectification of "advertising-oriented" issues.
Returning to events or cases that have caused hot topics in recent years, cases such as fines, negative public opinion, and business closures can be traced. The importance of advertising orientation is self-evident, and it needs to be highly valued by enterprises.
In 2019, the official account of a bank published an article entitled "Don't tell others, your belly is made big by us!" The official account tweet was determined by the Shanghai Market Supervision and Administration Bureau that the advertisement was derogatory to women and fined the bank 600,000 yuan and the advertising company 300,0
00yuan.
In early 2021, the full-time makeup remover advertisement caused an uproar among netizens because it involved insulting women. The full-time era sent a number of apology statements for this, and the incident had many negative effects on the brand perception of the full-time era.

In mid-2021, the famous talk show actor Li "a device that allows women to easily win in a breeze workplace" women's underwear advertisement caused an uproar, Li himself was fined more than 870,000 yuan, and his agency Xiaoguo Culture was fined more than 230,000 yuan.

In early 2023, an Internet celebrity self-heating pot released a product advertisement for "1.76 million get rich clam powder", and published a product advertisement containing "Garlic clam powder incident description" "Help girl" "Food poisoning after eating self-heating pot Follow-up, the deceased's husband provided the diagnosis result of hospitalization medical records" "The woman died after suspected eating self-heating hot pot? The police identified: The picture with the contents of the possible family claim for death due to acute food poisoning caused by consumption 1.76 million" was fined 800,000 yuan by the Shanghai Market Supervision and Administration Bureau because of the connotation "The woman suspected of eating self-heating pot died and claimed for 1.
76million social event".

In mid-2023, an electronic screen in an elevator in a certain building posted an advertisement for a hair removal instrument, using terms such as "advanced women use advanced" to grade women, which violated the good social fashion and was fined 212,600 yuan by the Municipal Supervision Bureau.
The above cases or incidents, on the one hand, bring administrative penalties and high fines to enterprises, and on the other hand, affect enterprises such as listing, enterprise award declaration, government subsidy declaration and other matters, and hinder the long-term stable development of enterprises. What's more, serious guidance problems may also lead to the closure of enterprises or even the rectification of the industry, and the impact is not far-reaching.
Part II, Advertising-oriented compliance methodology
The words "advertising orientation" and "orientation" are actually not directly explained by laws and regulations.
Judging from the key incidents of "orientation" problems in recent years, advertisements with "orientation" problems mainly include the following content, such as damaging national dignity, damaging national dignity, violating social public order or violating good social customs, superstition, gambling, etc. These situations seem to be found in Article 9 of the Advertising Law, but the author found that the connotation and extension of advertising orientation are far more than this.
Laws, regulations and normative documents
Advertising Law (2021 Amendment)
Article 9 Advertisements shall not have the following circumstances:
(1) Use or disguise the national flag, national anthem, national emblem, military flag, military anthem, and military emblem of the People's Republic of China;
(2) using or disguising the name or image of a state organ or its staff;
(3) Use terms such as "," superlative ", and" best ";
(4) harming the dignity or interests of the state or divulging state secrets;
(5) Obstructing social stability and harming social and public interests;
(6) Endangering personal and property safety and revealing personal privacy;
(7) Obstructing public order or violating good social norms;
(8) Content that contains obscenity, pornography, gambling, superstition, terror, or violence.
(9) Content that contains ethnic, racial, religious, or gender discrimination.
(10) Obstructing the protection of the environment, natural resources or cultural heritage;
(11) Other circumstances prohibited by laws and administrative regulations.
From the prompt letter of the Shenzhen Municipal Market Supervision Administration and the Wenzhou Municipal Market Supervision Administration on strengthening the review of advertising and publicity orientation, we can see that the "main legal and normative basis for guidance-related publicity" summarized by the regulatory authorities mainly includes the following contents:

You can see the advertising-oriented related laws, which can be extended to the "Cyber Security Law", "Trademark Law", "Heroes and Martyrs Protection Law", "Internet Information Service Management Measures", "Regulations on Ecological Governance of Network Information Content" and other content. Combined with the typical cases of the State Administration for Market Regulation, special project actions and typical cases across the country, advertising-oriented issues also include value orientation issues, ride on one's coattails, derogation of heroes, trafficking anxiety, sexism, derogation of women, causing public discomfort, soft pornography, racial discrimination, etc. The extension is quite broad.
In this way, companies and brands for advertising-oriented compliance control, seems to enter a rather vague, broad field.
However, combined with the relevant provisions of advertising-oriented content, special projects in various places, typical cases and public opinion hotspots, the author believes that the focus of advertising-oriented compliance is traceable, and it is recommended that enterprises and brands focus on the following directions.
Direction 1: Advertising campaigns also need to be politically sensitive and do not touch "red lines"
Judging from the typical cases of problem-oriented in recent years, one of the hardest hit areas is that advertising violates laws and regulations and involves party and government content. Such illegal advertisements focus on "using the name of the state in disguise" "using party and government conferences and national anniversaries for commercial marketing hype" "irregular use of national maps".
For such advertisements, the author recommends that companies focus on prevention, focus on the following content, and do not touch the "red line":
First, advertising content must not harm national dignity or national dignity, or endanger national security.
Second, advertising should not use or disguise the names, flags, badges, specific names, titles, songs, names or images of the party, state, government, military, and related units.
Third, advertising and marketing activities should not "borrow" and "rub" against national major policies, major events/conferences, anniversaries, political issues, and leaders' speeches.
Fourth, do not use maps unless necessary. If you need to use national maps, you can download them from the "Standard Map Service System" website hosted by the Map Technology Review Center of the Ministry of Natural Resources (URL: http://bzdt.ch.mnr.gov.cn). Do not change them at will.
The author selects two types of typical penalty cases for readers' reference, hoping that everyone can deepen their understanding of this compliance direction.

There are also eye-catching phenomena such as "gender opposition, belittling women, and objectifying women" in Internet advertising. If you pay attention to the hot searches on various platforms, you can find that "senior women use advanced", "women easily win in a breeze workplace", "wife obedient lozenges" and other sexist and vulgar advertisements have caused antipathy on the whole network.
For the grasp of content advertisements involving gender, male-female relations, women, etc., please refer to the content of the "Shenzhen Advertising Gender Equality Review Guide" issued by Shenzhen at the end of 2020; this content provides a clear definition of gender equality and gender discrimination, and lists the suspected sexist advertising content, which is very worthy of reference.

In sorting out various problem-oriented advertising cases, the author found that some administrative penalty decisions recorded the sources of some cases, such as "receiving public opinion feedback", "receiving reports", "found in daily advertising monitoring" and "according to reporting clues".
In the Internet environment, the "discovery" channels of problem advertisements are diverse. Guiding problem advertisements have been reported by media and online self-media reports including CCTV, Sanlian Weekly, and Xinhua News Agency on several occasions, and public opinion has fermented rapidly. Once it causes a "sensation" on the Internet, the negative impact it brings to enterprises and brands far exceeds the single category of traditional advertising violations.
Under the main line of guidance governance, the supervision standards for violating advertising guidance will become increasingly strict in the future. The author prompts enterprises and brands to attach great importance to the issue of "advertising guidance" and make compliance plans.
It is hoped that this article can provide a more complete perspective on "advertising-oriented" compliance, and provide some help for enterprises and brands in Internet advertising compliance.
