"Copyright Litigation Practice Sharing" Lecture Successfully Held

On the afternoon of August 9, 2023, Wang Qionghua, Secretary General of the Intellectual Property Center of

and Deputy Director of the Copyright Committee, Wu Yaping, Secretary General of the Copyright Committee, and Xu Xin, Secretary General of the International Department, were invited to Zhiheng (Longgang) Law Firm (hereinafter referred to as "Zhiheng Longgang") to give a special lecture entitled "Sharing of Copyright Litigation Practice". At the beginning of the lecture, lawyer Wang Qionghua shared the theme of "Defense Strategies of Defendants in Online Copyright Cases", starting from the main points of rights-based defense, and explained the basic components of the work. It focuses on the review of rights ownership, the review of authorization cases, multiple licenses, the judgment of ownership of transfer, and the defense of ownership.

Lawyer Wang explained the law by case, and comprehensively shared the legal basis and application conditions of the "safe haven rule". Finally, Lawyer Wang emphasized the importance of defending the amount of compensation and encouraged the defendant to abide by relevant laws and regulations while protecting their own rights and interests.

Lawyer Wu Yaping gave an in-depth explanation on the theme of "Analysis of Issues Related to Fine Art Works". First, he introduced the common categories of fine art works and listed relevant laws and regulations. Starting from the completion of creation, public publication and the originality of the works, he explained the main points of protection of fine art works.

Then enumerated two groups of deductive works comparison chart, and to introduce the infringement of conventional treatment. Finally, Wu lawyer with the actual case, once again explained to the audience the main points of art cases.

Lawyer Xu Xin shared the theme of "Discussion on Practical Problems of Written Works", briefly introducing the definition and general constituent elements of written works. Then, he shared three common forms of infringement of written works, gave a detailed explanation and case analysis on the infringement of distribution rights, the infringement of information network dissemination rights and the infringement of adaptation rights, and the infringement of filming rights. Combined with the experience of handling related cases in the past, he summarized the "three-step inspection method" for the determination of infringement of written works.

In addition, lawyer Xu Xin also showcased the identification points between genuine books and pirated books on the spot, reminding everyone that in the process of handling the case, they need to stand in the perspective of ordinary consumers and present their comparative opinions to the court in professional terms.
