I. Status of criminal cases involving trade secrets in Shenzhen
As an important part of the core competitiveness of enterprises, trade secrets play a crucial role in the survival and development of enterprises. The Public Security Law takes a cautious attitude towards criminal cases of infringement of trade secrets, especially in the reporting process. Therefore, the criminal case of infringement of trade secrets is in a low case rate.
However, he also introduced that since September 2020, when the Food, Drug and Environmental Crime Investigation Detachment was in charge of the investigation, the trade secret cases that were transferred for review and prosecution and have been closed have finally been convicted by the court of the alleged offender.

Nine. Three necessary identification and attention issues
Three necessary appraisals in criminal cases of trade secrets: "Non-public appraisal opinion", "Loss assessment report" and "Identity appraisal opinion". Among the three necessary appraisals, the first step is "Non-public appraisal opinion", the second step is "Loss assessment report", and the third step is "Identity appraisal". The appraisal of each link depends on the appraisal results of the previous link, and the three appraisals cannot be carried out at the same time.
For appraisal opinions and evaluation reports,
(1) The appraisal opinions, identity determination opinions and the assessment report that the amount of loss has reached RMB 300,000 yuan provided by the right holder when reporting the case can be used as the basis for filing the case, but when applying for arrest and prosecution, the appraisal report of a state-recognized appraisal agency with appraisal qualifications entrusted by the public security organ shall be submitted as evidence
(2) After identification, if it is determined that the identical secret points do not match the secret points on which the right holder submitted the major loss calculation when reporting the case, the right holder's losses shall be reassessed.
(3) If it is found that the collection of physical evidence or documentary evidence does not comply with legal procedures and may seriously affect judicial fairness, the case handling personnel shall make corrections or make reasonable explanations; if they cannot make corrections or make reasonable explanations, they shall be excluded according to law and shall not be used as a basis for requesting approval for arrest or transfer for review and prosecution.
(4) Re-entrusted appraisal: The investigation organ shall review the appraisal opinions, listen to the opinions of the right holder, alleged offender, and defendant on the appraisal opinions, and may request the appraisal agency to make corresponding explanations; it may send the appraisal opinions to other persons with specialized knowledge for comments. When necessary, ask the appraiser and make a transcript attached to the volume; if it meets the legal conditions for supplementary appraisal or re-appraisal, it shall supplement or re-appraisal.
X. Identification challenges at the judicial level of law enforcement
(1) The identification standards are not uniform
As far as the identification of trade secrets is concerned, there is currently no unified national standard, and there is no industry standard to follow. The identification method mainly adopts "technical methods recognized by most experts in the professional field".
(2) The quality of the appraisal institutions varies widely
The "Notice of the General Office of the Ministry of Justice on Launching the Cleanup and Rectification of Judicial Appraisal Institutions and Appraisals" stipulates that the registration of appraisal institutions and appraisers who are clearly engaged in "outside the four categories" of appraisal business shall be resolutely cancelled according to law.
(3) Lack of rights of the parties in the appraisal process
Filing a trade secret case generally requires the complainant to first commission an appraisal agency to issue a non-public appraisal opinion. Since the information submitted by the complainant cannot be presented to the accused during the investigation stage, without three appraisals, the accused will lose the opportunity to defend, which is not conducive to the protection of the rights of the accused.
(4) Appraisal fee report, the bidding process is complicated
The identification of trade secrets is highly technical and requires a large amount of data analytics. Experts need to invest a lot of time in identification, and the cost of entrusted identification is relatively high. In some cases, the cost of identification is even higher than the loss caused by infringement.
(5) There are few intellectual property appraisal institutions in Shenzhen
There are few intellectual property appraisal institutions in our city, and there are many high-tech enterprises in our city, which involve many intellectual property disputes. However, there are currently only two intellectual property appraisal institutions, Guangdong Public Standard Intellectual Property Judicial Appraisal Institute and Guangdong Anzheng Computer Judicial Appraisal Institute.
