Lawyer Li Huijie

Lawyer Li Huijie shared three aspects: an overview of historical illegal construction, non-litigation handling practices involved in historical illegal construction, and dispute resolution practices related to historical illegal construction.

Lawyer Li Huijie pointed out that the high-speed rural urbanization has promoted the economic take-off and development of Shenzhen, and also produced a large number of land historical legacy problems, triggering several rounds of rush to build, forming a large-scale historical illegal construction. The fundamental problem of the current historical illegal construction is that the legal system implemented cannot be coordinated with the rapid rural urbanization in Shenzhen for more than 40 years. Although there are special historical factors, historical illegal construction is still illegal construction.

How to deal with historical illegal construction? Lawyer Li Huijie shared his practical experience in non-litigation and litigation.

The non-litigation handling of historical illegal construction can be divided into three types: "two regulations" handling, new "three regulations" handling, and handling in urban renewal and land preparation projects. Lawyer Li Huijie introduced the handling scope, handling process and handling methods under the three handling modes.

Subsequently, based on the case search situation and combined with practical experience, lawyer Li Huijie simulated the scene of historical illegal construction disputes, and analyzed the common types of disputes and controversial issues in the practice of historical illegal construction-related dispute resolution. Lawyer Li Huijie concluded that litigation itself is not the end, but the goal is to strive for interests and prevent legal risks. After a dispute occurs, litigation means may have limited effect. It is more appropriate to coordinate non-litigation and litigation means in combination with the actual situation.
