In the field of prosecution and defense of fraud cases, how to provide legal services, how to file cases, and how to defend are issues of common concern to everyone. This sharing session invited lawyers with many years of experience in front-line case handling and practical defense experience to share their experience and insights, and discuss and exchange with everyone to achieve the effect of answering questions, sharing wisdom, and interoperability.

Lawyer Zhang Guoping, director of Guangdong Pengzheng Law Firm, has worked in the Public Security Bureau for 16 years, handling various commercial crimes. Since practicing law, he has mainly engaged in criminal non-litigation business and has rich practical experience in criminal law. Starting from some of the fraud cases he handled, lawyer Zhang Guoping vividly explained the understanding of fraud cases from the past, present and historical development of fraud cases, to the cross-competition between fraud and other crimes, and then to the identification points and judicial practice of public security organs investigating fraud cases.

Lawyer Zhang Guoping proposed that when organizing the preparation of case reporting materials, we should stand in the perspective of lawyers, discard redundant descriptions, use the law as a spear and shield, and strictly follow the legal logic to solve problems.

Zhang Zizhu, a senior partner of Guangdong Shengdian Law Firm and deputy director of the Financial Crime Defense Committee of Shenzhen Lawyers Association, discussed from three directions: the defense of contract fraud crimes in gambling agreements, the defense of contract fraud crimes in pallet trade financing, and whether the defendant's liability for compensation in fraud crimes can be exempted due to the victim's abandonment, explaining past classic cases, and summarizing experience and common logic.

Yi Fan, a partner of Beijing Yingke (Shenzhen) Law Firm and an assistant lawyer to the director of the Commercial Crime Defense Professional Committee of Shenzhen Law Association, shared his practical experience in handling cases and summarized four requirements for successful criminal prosecution: 1. Prepare a set of report materials that meet the formal requirements of the case-handling authority; 2. Prepare a legal opinion with sufficient arguments and clear arguments; 3. Have an unyielding heart of failure and repeated battles; 4. Pay attention to investigation and evidence collection.

When preparing the report materials, it is necessary to pay attention to the requirements of the handling agency, and the accusation should be kept in mind that the reporting standard should be higher than the filing standard, and false accusations, blind trust, and blind rights protection should not be allowed.
