Ningbo spouse is in debt outside, and what if the house is sealed up?

When a house is suddenly seized by the court, many people’s first reaction is, “It’s over—there’s no way to keep this property.” Let’s state the conclusion clearly first:The fact that a house is seized does not necessarily mean that it will be auctioned and sold.Seizure is merely a control measure within the enforcement procedure; it freezes the right to dispose of the property but does not directly deprive the owner of ownership. What ultimately determines whether this property will be used to satisfy the debt comes down to two questions: First,Is this debt "your husband and wife" debt or not?; Second,Who exactly belongs to the seized house in terms of ownership and whose part can be enforced。

1. judge first: is this debt of "you two" or not?

The spouse is in debt outside, and the creditor takes the effective judgment to enforce the family house. The first step is not to rush to complain, but to see the nature of the debt clearly. According to Article 1,064 of the Civil Code, there are only three categories of marital joint debts: first, debts jointly signed by both spouses, or debts subsequently ratified by one spouse—commonly referred to as “joint debt, joint signature”; second, debts incurred by one spouse in their own name during the subsistence of the marriage for the needs of daily family life, such as ordinary household expenses, medical treatment, and children’s education; third, debts incurred by one spouse in their own name that exceed the needs of daily family life—such debts are, in principle, not considered joint debts unless the creditor can prove that the funds were used for the common life of the couple, for their joint production and business activities, or were based on a joint expression of intent by both parties.

The most important change in this rule is the allocation of the burden of proof. In the past, debts incurred during marriage were simply presumed to be joint marital debts; now, the reverse applies: amounts exceeding the needs of daily family life,It is up to the creditor to prove that it is a joint debt.If you can't prove it, it's treated as a personal debt. In practice, the most common sources of dispute—such as large private loans, gambling debts, guarantees provided for others, or one party’s sole external investments or business losses—are typically difficult to recognize as joint marital debt if the other party neither signed nor subsequently ratified the obligation, and the funds were not actually used for the family’s basic needs of food, clothing, housing, and transportation.

2. the treatment of common debt: common property can be executed.

If the debt is indeed a joint debt of the husband and wife, the conclusion will be more direct:The joint property of the debtor's husband and wife, including those parts registered in the name of the unindebted spouse that are essentially the joint property of the husband and wife, may be used for liquidation.

What property is the joint property of the husband and wife? Article 1062 of the Civil Code stipulates that the wages, bonuses, remuneration for services, income from production, business and investment, income from intellectual property rights, inherited or donated property, and other property that should be owned jointly by the husband and wife during the marriage relationship shall be jointly owned by the husband and wife, and both parties shall have equal rights to dispose of it. When it comes to real estate, any property purchased during the marriage and repaid with marital income is generally considered joint marital property, regardless of whose name it is registered under; the registration does not alter its status as joint property.

Therefore, in the case of joint debt, it is difficult for one spouse to exclude execution only by "the house is registered in my name" or "the debit note is not signed by me", because the joint debt should have been paid off with common property. At this point, a more practical approach is to start fromWhether the amount of the debt is true and whether it has exceeded the standard of seizure.And so on, the scope of implementation to a reasonable limit.

3. the treatment of personal debt: only the debtor's share can be moved.

If the debt is recognized as the personal debt of one of the spouses, the rules are completely different. At this time, the scope of the creditor’s enforcement,limited to the debtor's personal property and his share of the common property, Can not be implicated in the other party's share, let alone the whole set of husband and wife shared houses without differentiation.

Article 12 of the Provisions on Seizure, Seizure and Freezing of Property makes it clear that the people's court may seal up, seize and freeze the property shared by the executed person and other people, but shall notify the co-owners in a timely manner. If the co-owners agree to divide the common property and are approved by the creditors, the people's court may determine it to be valid. At this time, the effect of the seizure is only the property within the share of the share enjoyed by the executed person after the division, the property within the share of other co-owners shall be ruled to be discharged; if the co-owner files a property analysis action or applies for the executor to file a property analysis action on behalf of the executor, the people's court shall grant the suspension of the execution of the property during the litigation.

This line of thinking is similar to the principle of heritage division. Article 1,153 of the Civil Code provides that, with respect to property jointly owned by spouses, unless otherwise agreed, half of such jointly owned property shall first be allocated to the surviving spouse upon the division of the estate, with the remainder constituting the estate of the deceased. The underlying principle in enforcing the execution of jointly owned marital property, particularly housing, is to first carve out the half that belongs to the other spouse.

In other words, in the case of personal debt, even if the house is sealed, the law still protects "the other person's half". This is precisely the most crucial fulcrum when subsequently raising an objection or filing an objection lawsuit.

4. the house is sealed, do these things first.

The first step is to get and read the seizure ruling. Obtain from the executing court the “Order on Seizure, Detention, and Freezing of Property,” the “Notice of Assistance in Execution,” as well as the basis for execution (the final judgment, mediation agreement, or ruling). Carefully review: who is identified as the debtor in the basis for execution, the amount of the debt owed, the date and duration of the seizure, and whether the scope of the seizure covers the entire property or only a specific share. If the spouse is not listed as a debtor in the legally effective document, then the spouse’s share of the property is not subject to enforcement in the first place, which in itself constitutes an important ground for excluding such enforcement.

The second step is to distinguish two relief paths. One avenue is “objection to enforcement,” which challenges the court’s enforcement actions themselves, such as over‑seizure or the seizure of property unrelated to the debt; the other is “enforcement objection litigation,” which addresses the substantive ownership of the subject matter of enforcement. The procedures, time limits, and evidentiary requirements for the two are different; taking the wrong path will only waste your time. Special attention should also be paid to seizures that exceed the prescribed limits: According to the “Provisions on Seizure, Detention, and Freezing of Property,” when seizing, detaining, or freezing the property of the party subject to enforcement, such measures shall be limited to an amount sufficient to satisfy the creditor’s claim and cover the enforcement costs; they must not significantly exceed this limit. If the person subject to enforcement already owns property sufficient to satisfy the debt, yet the court still seizes property registered in the spouse’s name, this constitutes a circumstance under which an application for lifting the seizure may be filed.

How to raise objection to 5. execution: subject, deadline and materials

According to Article 234 of the Civil Procedure Law, in the course of execution, if an outsider raises a written objection to the subject matter of execution, the people's court shall examine it within 15 days from the date of receipt of the written objection, and if the reason is established, it shall rule to suspend the execution of the subject matter; if the reason is not established, it shall rule to reject it.

Who can mention. A spouse who is not a debtor may file the motion as a non-party; other co-owners who have substantive rights with respect to the property may likewise do so. To whom should it be proposed, and when? Submit your request to the court responsible for enforcement as early as possible—ideally before the property is appraised or put up for auction. Once the auction process has begun, your position will become significantly more disadvantageous.

What needs to be handed in. Typically, the required documents include a written application for enforcement objection (stating the request to suspend enforcement against the property, lift the seizure, and providing supporting reasons), proof of identity, proof of marital status, proof of property ownership (real estate certificate, purchase contract, and evidence of contributions and mortgage payments), a copy of the seizure order, as well as any other evidence that can establish the nature of the debt or the attribution of rights.

After receiving the written objection, the court will review and make a ruling within 15 days: if the objection is established, the execution shall be suspended; if it is not established, it shall be rejected. It should be noted here that the fifteen-day period refers to the court’s review period, not the time limit for the parties to take action; the time limit for the parties to act after receiving the ruling is very tight, as will be discussed in the next section.

How to fight the 6. execution objection: the 15th is a hard deadline.

After the execution objection is rejected by a ruling, if you are not satisfied with the ruling, you should deal with it in two situations: if you think that the original judgment or ruling on which the execution is based is wrong, you should go through the trial supervision procedure, that is, apply for a retrial; If it has nothing to do with the original judgment or ruling, the dispute revolves around the ownership of the subject matter of execution, then the outsider or the party concerned may, within 15 days from the date of service of the ruling, file a lawsuit against the execution of the objection to the people's court. The fifteen-day period is a non-extendable deadline, calculated from the date of receipt of the ruling. If the deadline is exceeded, the court will not accept the case; if the case has already been accepted, the court will issue a ruling dismissing the lawsuit.

The burden of proof falls on the side of the outsider: the outsider who claims that he has a civil interest in the subject matter of execution that is sufficient to exclude enforcement should bear the burden of proof. With regard to property jointly owned by a married couple, courts typically consider fromThe time of formation of the right, the content of the right, the nature of the right and the impact on the interests of the relevant subjects.Several aspects are compared and judged. When it comes to specific evidence, focus on preparing the following categories:

  • Evidence of capital contribution for the purchase of a house: the source of the down payment, bank flow, transfer records, subscription books, sales contracts, used to prove when the house was acquired and by whom the capital contribution was made;
  • Repayment records: mortgage repayment certificates, certificates of early settlement of loans, especially materials that can prove that the unindebted spouse repays the loan alone;
  • Property right registration: real estate certificate, real estate register, clear registration status and common situation;
  • Marital relations: marriage certificate, divorce agreement or divorce judgment, mediation, and the date of their entry into force;
  • Evidence of a negative joint debt: evidence that the debt was formed, the purpose of the funds, and evidence that it was not used for family life or joint business, such as communication records, witness testimony, and the flow of funds.

In the first category, if the right is formed later and there is a suspicion of avoiding the debt, it will be rejected.In a case heard by the People's Court of Panyu District, Guangzhou City, Luo and He bought a house during their marriage and registered the house under Luo's name; when the two agreed to divorce, they agreed that the house would belong to He, and then signed a supplementary agreement and notarized it, and changed the agreement to Luo. Mou. The court found that He’s external debts had been incurred prior to the amendment of the agreement, and that the amended division of assets clearly favored Luo, thereby reducing He’s ability to repay his debts. Ultimately, the court determined that the existing evidence did not rule out the possibility that the parties had entered into a sham agreement to evade debt, rendering the relevant civil legal acts invalid, and dismissed Luo’s request to exclude the assets from execution.

In the second category, if there is insufficient evidence to prove the change of ownership, it will also be rejected.In a case tried by the People's Court of Yongdeng County, Gansu Province, Wang Mouxia advocated signing a "Repayment Agreement" with Xue Mouwen after divorce, and using the house to repay the debt to her own. The court found that the date of the agreement had obvious signs of alteration, and the cash receipt it submitted did not corroborate the source or destination of the funds. Consequently, it was unable to establish that the debt‑settlement payment had been actually made, and ultimately determined that Ms. Wang Xixa did not possess any legal interest in the property sufficient to preclude enforcement proceedings.

The third category, the right to form a prior, not for their own reasons have not been transferred, can be supported.In a case heard by the People's Court of Louxing District, Loudi City, Hunan Province, Chen Mou and Xie Mou A divorced. The effective mediation document determined that the disputed house was owned by Chen Mou and his married daughter, and the remaining loan was repaid by Chen Mou. The division time was earlier than the seizure time of the debt execution. The house can only be transferred after the mortgage is still secured and the transfer is not due to Chen Mou's own reasons. After deliberation, the court held that the creditor’s claim is directed to all of the water plant’s and its operator’s assets subject to liability, rather than solely to the said house, and ultimately ruled to suspend the compulsory execution against the house.

In the fourth category, if the house has been owned by the spouse due to the effective divorce referee and there is no malicious collusion, execution can be excluded.In another case tried by the People's Court of Panyu District, Guangzhou City, the debtor determined on the basis of enforcement was Chen Mouhua (the guarantor who bears joint and several liability). The divorce judgment between Li Moumei and Chen Mouhua took effect before and after the seizure. The house was awarded to Li Moumei, and there is no evidence that the two maliciously colluded to transfer property. The court determined that the property no longer constituted the debtor’s assets subject to enforcement and dismissed the applicant’s request for continued enforcement.

Comparing these four categories, the winners and losers of outsiders are actually very clear:Whether the rights were formed earlier than the seizure, whether the change of ownership had real consideration and sufficient evidence, and whether there was any sign of evading debt by divorce or agreement.. Each of the three tasks is worth one point; the more thoroughly they are completed, the more advantageous it will be.

7. the only housing can be executed

Many people regard "this is my only house" as a universal shield. This understanding needs to be corrected."The only house" and "necessary living house" are not the same concept.According to the provisions on the seizure, seizure and freezing of property, the people's court may seal up the residential houses necessary for the life of the person subject to execution and his dependent family members, but may not auction, sell or pay off debts; only when certain conditions are met, they can be disposed. Article 20 of the “Provisions of the Supreme People’s Court on Several Issues Concerning the Handling of Execution Objections and Review Cases by People’s Courts” (Interpretation [2015] No. 10) further enumerates the circumstances under which execution may proceed: where a person who has a duty to support the judgment debtor owns other residential housing sufficient to meet their basic living needs; where, after the enforcement basis takes effect, the judgment debtor transfers other properties registered in their name in order to evade debt; or where the applicant for enforcement provides residential housing for the judgment debtor and their dependents in accordance with the local affordable rental housing guarantee area standards, or agrees to deduct five to eight years’ worth of rent, calculated based on the average rental rates in the local housing market, from the proceeds of the sale of the property.

In a word, the only housing is not absolutely unmovable, but the law guarantees basic living conditions are rigid. For the spouse whose liability has not been recognized, the more pressing issue is not whether the “only residence” can be subject to enforcement, but rather whether the share of that property belonging to them can be enforced. As long as it can be proven that the debt is the personal debt of the other spouse, one may assert that only the debtor’s share should be disposed of, or that, after partition of the marital property, only the portion actually subject to enforcement should be targeted.

8. prevention and practical recommendations

To deal with such disputes, after-the-fact remedies are far less than prior arrangements. Here are a few actionable directions.

  • Marital Property Agreement: Both parties may agree in writing that the property acquired during the marriage shall be owned by each party, or part of it shall be owned by each party and part of it shall be jointly owned. It should be noted that such agreements are only effective between the spouses and generally do not bind creditors who were unaware of them. It is therefore advisable to ensure that creditors are informed of and confirm such arrangements at the time the loan is made.
  • Joint debt isolation: large foreign loans, guarantees and investments of one of the spouses, the non-participating party to try not to sign, not to ratify, if it is necessary to share, but also to leave a written record of the use of funds.
  • Ownership and capital contribution: the house is registered in whose name, the down payment and repayment of the loan from whose account, should be documented. When borrowing money from parents or relatives, or having someone else pay the housing costs on your behalf, be sure to keep the loan agreement and bank transfer records.
  • Timely analysis of property within marriage: when the marital relationship is obviously unstable, or the debt risk of one party is high, the shared property can be divided by agreement or litigation to fix the share. Don't wait until after the seizure, when the agreement can easily be identified as debt avoidance.
  • The divorce agreement should be standardized: the property division clause should be matched with the debt treatment and compensation obligations, avoiding the unbalanced arrangement of "the house belongs to one party and the debt remains to the other party", and avoiding the contradictory agreement signed afterwards.

9. Frequently Asked Questions

The house is sealed, will it be auctioned soon?

No. Seizings are only control measures, the auction to go through the evaluation, announcement, bidding and other links. As long as a valid objection or lawsuit is filed before disposition, there is still a considerable buffer time. The really urgent deadline is to prosecute within 15 days after receiving the execution objection ruling.

The house is only registered in my name. Can the spouse be seized for debts?

Yes, but it depends on the physical ownership of the house. If the house is purchased within marriage and repaid with joint income, it is usually the joint property of the husband and wife, even if it is registered in the name of only one party. In the case of personal debt, the debtor's share of the common house may be enforced, but the share of the unindebted spouse shall not be implicated.

I didn't sign the IOU, and I didn't spend the money. Do I need to take care of it?

need to manage, and stand in their favor. For debts exceeding the needs of daily family life, the burden of proof lies with the creditor. As long as you don't have a joint signature, no ex post facto recognition, and the money is not used for family life or joint business, you have the opportunity to claim that this is a personal debt of your spouse and limit the scope of execution to the debtor's share.

has seized our common property, can we ask for only half of it?

can claim this. After the joint property has been seized, the co-owner may agree to divide it and be approved by the creditor, and the effect of the court's seizure shall only extend to the property within the share of the executed person, and the property within the share of the other co-owners shall be lifted.

Is it enough to choose one of the enforcement objections and the enforcement objections?

No way. The execution objection solves the legality of the execution act, such as whether it exceeds the standard of seizure, and the execution objection solves the entity ownership of the subject matter of execution. In order, a written objection is usually raised in the enforcement procedure, and after the objection is rejected, a lawsuit for enforcement objection is filed within

15days.

Missed the 15th, is there any remedy?

The 15th day of filing the execution objection lawsuit is the same period, and the overdue court will not accept it. However, it is not that there is no way out at all. We can consider applying for retrial, filing a separate confirmation or a lawsuit for property analysis according to the specific situation. The specific way to go should be judged according to the content of the ruling and must be handled as soon as possible.

10. Lawyer's Practical Insights

If the house is sealed up, don't panic and decide that "this suite can't be kept". The seizure is only a control measure in the implementation, the freezing is the disposition of the power, does not mean that the inevitable auction. Upon receiving the notice, you must promptly clarify two matters: whether the debt in question is indeed a joint obligation of the spouses, and to whom the seized property is legally owned, as well as which portion belonging to that party may be subject to enforcement. When judging the nature of the debt, don't just look at "who signed it", but whether the money is really used for the family; at the same time, get the basic materials such as the loan contract and transfer voucher submitted by the applicant as soon as possible, so as to have a bottom in mind.

Time is of the essence in seizure cases. If there is any objection to the execution, a written objection shall be raised within the statutory time limit. The materials shall be prepared around the two main lines of "nature of debt" and "ownership of property": large loans, gambling debts, external guarantees and independent investment losses incurred by one party in the name of an individual, together with evidence that you have not signed, ratified and the funds have not been used for the family. If the objection is rejected, but also pay attention to the follow-up litigation of the hard deadline, missed deadline relief channel is basically closed. At the same time, it is possible to apply for correction of excessive seizures and erroneous seizures, and to reduce the scope of execution to a reasonable limit, rather than passively waiting for auctions.

Daily prevention is more important than post-remediation. Usually keep the family expenses by you or both parties to bear the evidence, the spouse to keep informed of the large amount of external debt, once found that the other party in the negotiation or litigation period low-cost transfer of property, surprise transfer of deposits, timely fixed clues and consider applying for preservation. In cases where one spouse's debt affects the property, the outcome is often not in the law but in the timely preparation of evidence, and the first party is often more active. The house is your place to stay, and holding every step steadily is better than emotional confrontation.

The core of the problem is never "whether the house will be lost or not", but two judgment questions: Whether this debt is a joint debt, what part of the suite can be enforced. If the debt is a joint obligation, the joint property may be used to satisfy it; if it is an individual debt, only the debtor’s share of the joint property may be used. Around these two points, it is safe to fix the evidence, distinguish the procedures and grasp the time limit as soon as possible. What really determines success or failure is often the timeline of the formation of rights, the vouchers for capital contributions and loan repayments, and whether there are traces of debt avoidance by divorce or agreement. Upon discovering the seizure, action should be taken as soon as possible: first obtain the seizure order and the underlying enforcement basis to determine the nature of the debt, and then decide whether to file an objection to the enforcement or to directly prepare a lawsuit challenging the enforcement. Don’t wait until after the auction notice is posted to start—by then, you’ll have much less control.
