Can Ningbo creditors add the debtor's spouse as the executor?

The husband incurred debts while away from home, and the final judgment ordered him alone to repay them. During enforcement proceedings, the creditor discovered that no assets could be found under the debtor’s name, yet the family was living in a house registered under the wife’s name and driving the wife’s car. Many creditors in Ningbo’s first reaction is: Can the debtor’s spouse also be added as a party subject to enforcement, so that property under her name can be enforced as well?

The answer has two parts:In principle, the spouse may not be directly added as a party to be enforced against during the enforcement phase; however, creditors have five avenues for “penetrating” the marital property shield. The most commonly used approach is to file a separate lawsuit to confirm the existence of joint marital debt, or—without adding any additional parties—to directly enforce the portion of the jointly owned property held in the spouse’s name that belongs to the judgment debtor.Next, I will explain in the following order: “Why appending is not allowed—five pathways—practical implementation.”

1. Why can't the spouse be directly added as the party to be enforced against during the enforcement phase?

First, distinguish between the enforcement procedure and the basis for enforcement. The object of compulsory enforcement is the obligor specified in the legally effective document; the task of the enforcement procedure is to realize the rights and obligations determined by the judgment, rather than to re‑litigate “who should be responsible for this debt.” Adding a third party as an enforced debtor effectively imposes substantive liability on that party without any basis in the judgment, and the law has thus imposed two safeguards.

The first safeguard is the principle of statutory supplementation. The Provisions of the Supreme People's Court on Several Issues Concerning the Alteration and Addition of Parties in Civil Enforcement (Fa Shi [2016] No. 21, effective as amended in 2020) list the circumstances in which the person subject to enforcement can be added one by one: when the property of an enterprise legal person is insufficient to pay off, shareholders, investors and promoters who have not paid or have not made full contributions can be added (Articles 17 to 19); A shareholder of a one-person company who cannot prove that the company's property is independent of his own property (Article 20); a shareholder, director and controlling shareholder whose company is canceled without liquidation (Article 21); and a sole proprietorship investor, general partner, etc. “Nothing may be done unless expressly provided for by law.” This list pertains solely to shareholders, investors, partners, and liquidation obligors, and it has never included “spouses” as entities that can be added as parties.

The second safeguard is the separation of adjudication and enforcement, along with procedural guarantees. Whether a debt constitutes joint marital debt is a quintessential substantive dispute, involving factual determinations such as the purpose of the loan, whether it exceeds the needs of daily family life, and whether it was used for joint business operations. The law vests the power of judgment in the judicial proceedings. The spouse typically did not participate in the original trial and therefore did not file a defense or present evidence; in principle, the res judicata effect of the final judgment does not automatically extend to third parties who did not take part in the litigation (the relativity of res judicata). However, bringing the spouse into the enforcement proceedings by means of a single court order effectively deprives them of their right to due process. Therefore, the “Notice of the Supreme People’s Court on Lawfully and Properly Adjudicating Cases Involving Marital Debts” (Fa [2017] No. 48) has set a clear bottom line:No party to a marriage who has not incurred the debt may be required to bear civil liability without due judicial proceedings."

The judicial stance has long been unified. The Supreme People’s Court, in its Execution Ruling No. 111 of 2015, explicitly stated that the addition of a judgment debtor must adhere to the principle of legality; neither existing laws nor judicial interpretations provide for the addition of a judgment debtor’s spouse during the execution proceedings. The case “Application by a Village Committee to Add Xie as an Enforced Party” (case accession number 2023-17-5-300-003), included in the People’s Courts Case Database, also holds that the application to add the enforced party’s spouse as a party to be enforced exceeds the statutory circumstances and should therefore be rejected. Conclusion: During the enforcement phase, it is neither permissible to recognize “this as a joint debt of the spouses,” nor is it appropriate to, on that basis, include the spouse in the list of persons subject to enforcement.

2. A Comprehensive Overview of Remedial Paths: Five Penetration Paths and Three Types of Litigation

The subject can't be added. If the creditor wants the property under the name of the spouse to repay the debt, it can be summed up as five penetration paths: ① execute the share of the common property of the husband and wife under the name of the spouse that belongs to the debtor; ② revoke the unreasonable property division clause in the divorce agreement; ③ confirm the invalidity of the relevant clauses in the divorce agreement on the grounds of malicious collusion; ④; ⑤ Confirm that the debt is a joint debt of the husband and wife and require the husband and wife to pay it off together.

From the perspective of litigation types, these five avenues can be categorized into three types of lawsuits:

  1. Ordinary litigation—directly file a lawsuit to require the obligor(s) (both spouses or one spouse) to assume the debt; corresponding procedure ⑤.
  2. Avoidance Right Litigation-For the debtor's behavior of improperly disposing of property and reducing solvency (such as selling a house at a low price and giving all the property to the spouse in the event of divorce), revoke the behavior to increase the responsible property, corresponding to the path ②; Confirmation of invalidity by malicious collusion (Article 154 of the Civil Code) has similar mechanism and corresponding path ③.
  3. The third party's revocation suit-when the debtor and others have obtained the effective legal documents (such as the judgment of awarding the property to the spouse, the mediation statement), they can no longer rely on the revocation litigation to "withdraw the document", and can only bring the third party's revocation suit to deny the document, so as to restore the debtor's liability property.

You can remember the division of responsibilities this way: if property has been “disposed of,” pursue a revocation action; if the outcome of the disposal is recorded in an effective court document, file a third-party revocation lawsuit; and if you want to hold the spouse directly liable, seek recognition of joint debt. These three avenues can be pursued concurrently.

Detailed Explanation of 3. Path (Part 1): Execute the share of common property, revoke the terms of divorce agreement, and confirm that the agreement is invalid.

1. Path ①: directly execute the share of common property under the name of the spouse without adding the subject

If the spouse is not the party subject to enforcement, may the court seize property registered in their name? Yes, but only to the extent of the “portion of jointly owned marital property that belongs to the party subject to enforcement.” Based on Article 14, paragraph 1, of the Provisions of the Supreme People's Court on the Seizure, Seizure and Freezing of Property in Civil Execution by People's Courts:"The people's court may seal up, seize and freeze the property shared by the executed person and other people, and notify the co-owner in time." In addition, the division agreed by the co-owners and recognized by the creditors can be recognized as valid; if the co-owners or the executor applies for execution subrogation to bring property analysis litigation, the court should allow it, and the execution shall be suspended during the litigation.

The warehousing case "Implementation Case of Wu Moumou and Gao Moumou" (warehousing number 2024-17-5-101-005) is this path: there is no property available for execution under the name of the person subject to execution, and the court finds out that the bank deposit under the name of his spouse is more than 170,000 yuan, so it freezes part of the deposit and notifies the spouse in time, and finally deducts the debt. The rationale is that wages, bonuses, remuneration for services, and investment income acquired during the subsistence of the marriage are jointly owned by the spouses; if the spouse cannot prove that the deposit constitutes their personal property, the court may order its freezing.

The difficulty lies in "what can be touched and how much can be touched". The key to determining whether property is jointly owned lies in the time of acquisition—property acquired during the marriage is, in principle, presumed to be marital property, even if it is registered solely in the name of one spouse. (2018) The Supreme People's Court ruled No. 2802 that the real estate and parking spaces registered in the name of the spouse, which have no evidence to show that they are owned by the individual, should be recognized as the joint property of the husband and wife, and the court sealed them up in accordance with the regulations. (2019) The Supreme People's Final Judgment No. 1868 clearly states that when the overall disposal of the common house is carried out, half of the realized share of the spouse shall be retained. Therefore, the share that can be disposed of is generally limited to 1/2; those that can be disposed of in zeros (e. g., deposits) directly execute the debtor's share, and the share cannot be divided or divided (e. g., real estate) that would significantly detract from value is auctioned off as a whole. Court-ordered property inquiries typically do not proactively investigate assets held in the name of the spouse. The application executor must proactively provide real estate registration, vehicles, bank account clues and apply for seizure in writing.。

2. Path 2: Revoke the unreasonable property division clause in the divorce agreement

Debtors often evade their debts by “dividing” their assets with their spouses through divorce. Whether the divorce agreement can be used as the object of revocation is no longer controversial after Article 3 of the Interpretation (II) of the Supreme People's Court on the Application of the Marriage and Family Code of the the People's Republic of China Civil Code is clarified: the property disposition clause of the divorce agreement is independent, and as long as the creditor's claim is damaged, the creditor can request revocation with reference to Article 538 or Article 539 of the Civil Code. There are three elements: first, the creditor's right is formed before the debtor's divorce and is a personal debt (if it is a common debt, it can be claimed directly to both parties); Second, the division of property is unreasonable and harmful to the realization of creditor's rights. When judging, factors such as the overall division and performance of property, the burden of child support, divorce fault, etc. should be integrated. Third, it should be exercised within one year from the date when the reason for cancellation, generally from the date of knowledge of the specific terms rather than the date of divorce.

Not all “leaving with nothing” agreements can be revoked. (2021) In the case of Yue 03 Min Zhong No. 5181, the court held that the divorce agreement has identity attributes and must consider the marriage fault, child support and property division as a whole: the real estate involved was purchased by one party before marriage and was the only residence of the mother and child, while the other party had gambling habits and did not take care of the family for a long time. The agreement "not a free transfer without consideration" to the party raising the children, so it was not revoked. It is evident that one must determine whether the division constitutes a “significant imbalance” and whether there is a reasonable consideration.

3. Path ③: Confirming the invalidity of the terms of the divorce agreement with "malicious collusion"

If the one-year limitation period has expired, or if it is inconvenient to exercise the right of revocation, one may instead pursue a claim for “confirmation of invalidity”—pursuant to Article 154 of the Civil Code, a civil legal act entered into by the parties in collusion with malicious intent to the detriment of the legitimate rights and interests of others is void. It is a confirmation of the lawsuit, not subject to the statute of limitations, which is the greatest advantage of the relative right of revocation. (2024) Lu 0827 Minchu No. 1165 case confirmed that the agreement "all property belongs to the woman" in the divorce agreement was invalid.

The legal consequences of the two paths should be implemented: if the real estate transfer has been handled according to the divorce agreement, and the terms are canceled or invalid, the creditor can apply for registration reversal (before the change of registration), and apply for preservation in time and resume execution according to the effective payment judgment. The divorce agreement is an internal agreement between the husband and wife and cannot be opposed to bona fide creditors.

Detailed Explanation of 4. Path (Part II): Subrogation of Property Analysis, Confirmation of Joint Debt of Husband and Wife

1. Path ④: Subrogation against the common property under the name of the spouse

For the property registered in the name of one spouse, which is difficult to determine the common share, the court sometimes does not dispose of it directly after sealing it up, but requires to analyze the property and determine the share before executing it. Spouses are often lazy in the analysis of the property, at which time creditors may file a subrogation of the property, based on the seizure of frozen provisions of article 12, paragraph 3. Four conditions are usually required: the creditor has a claim against the debtor confirmed by the effective instrument; the claim has been applied for enforcement; there is no other enforceable property in the debtor's name other than common property; and the co-owners have not claimed or neglected to split the property. The lawsuit takes the creditor as the plaintiff and the husband and wife as the defendant, and requests the confirmation of each party's share.

(2025) Yun01 MinZhong No. 518 case is this: the debtor is unable to repay the loan and the final execution of the contract, and the divorce agreement between the debtor and the spouse stipulates that the real estate belongs to the spouse, but the agreement has been revoked by the effective judgment, the real estate is still the joint property of the husband and wife, the creditor subrogation analysis of the property, the court confirmed that the two persons each have 50% share. The dispute is whether the subrogation of the property is based on the premise of the seizure, more unnecessary-the execution stage usually does not seize the spouse's name of the house, if not seized rejected, creditors will fall into a "dead cycle". Therefore, it is suggested to try to seize the property under the spouse's name as much as possible. When it is not possible to win, explain the reasons in the case of property analysis to persuade the judge to confirm the power and property analysis.

2. Path ⑤: Confirm the joint debt of husband and wife and require both parties to pay off the debt together

This is the official channel for “bringing your spouse into the fold.” A creditor, on the ground that the debt determined by a final and effective judgment constitutes joint marital debt, brings a separate lawsuit against the spouse, seeking a judicial determination and an order for joint repayment. The cause of the case is "dispute over confirmation of joint debt of husband and wife". The substantive basis is Article 1064 of the Civil Code: debts expressed by common meaning such as joint signature or subsequent ratification, as well as debts incurred for the daily needs of the family, are common debts; Generally speaking, debts that exceed the needs of the family's daily life are not joint debts, unless the creditor can prove that they are used for the joint life of husband and wife, joint production and operation or based on the expression of common meaning. Proof is the winner and loser: the amount is relatively loose within the scope of daily life needs; Obviously beyond the daily needs (e. g. hundreds of thousands, millions of dollars), the creditor's proof of use, insufficient proof will bear the adverse consequences.

The ratification after the event does not need to stick to the written form, but can be judged by telephone recording, short message, WeChat, email and so on; the joint production and operation often rely on the comprehensive identification of bank running water and so on. (2023) In the case of Liao 02 Min Re-21X, the court found that the spouse held the financial expenses of the project, repeatedly transferred the funds in the name of "repayment of loan interest" and "payment of project funds/wages", and determined that the debt was used for the husband and wife to live together and jointly produce and operate, which was a common debt.

5. Procedural Practice: Listing Co-Defendants During the Litigation Phase, and Applying for Preservation, Filing Defenses, and Determining Necessary Shares During the Enforcement Phase.

First, if it can be identified as a joint debt at the litigation stage, don't put it off to the enforcement stage. If it is considered to be a joint debt, the spouse should be directly listed as the co-defendant when filing the case; if the spouse is omitted to be sued when filing the case, an additional application should be made as soon as possible before the expiration of the time limit for proof or before the hearing, and the application should be made after the hearing, and the judge may not allow it. In the event that a party to a joint debt is omitted, a subsequent supplementary action may be considered a duplicate action.

Second, the security should be "husband and wife together".Suing both spouses simultaneously allows for the preservation of property held in the names of either or both parties, thereby preventing one spouse from transferring assets without incurring additional litigation costs.Even if the court does not decide that the spouse is responsible, the execution stage may still claim that the property in the spouse's name belongs to the joint property of the husband and wife, and apply for preservation and execution.

Third, the execution of the common property is to reserve the necessary share for the spouse. If the debt belongs to one party's personal debt, the whole house (such as 1 million yuan real estate) can be auctioned when executing the marriage, but the due share (generally half) must be reserved for the spouse, and only the remaining part of the debtor can be executed.

Fourth, the spouse can defend according to law after being sealed up. If the spouse thinks that the sealed-up property is his own personal property, not common property, which is the substantive right to the subject matter of execution, he can raise a written objection according to the provisions of the Civil Procedure Law on the objection of the outsider (current Article 234). If the spouse is rejected, he can file a lawsuit of the objection of the outsider within 15 days from the date of service of the ruling; if it is only believed that the execution is illegal and measures should not be taken against the common property, it is an objection to the execution, which may be raised in accordance with the current Article 232. If it is not satisfied, it may apply to the higher court for reconsideration within 10 days. The entity spouse often defends on the grounds that the property is personal property, the debt is the other party's personal debt, and the debt is an illegal debt.

class case reference: in the execution stage, the debtor's spouse is not directly added as the executed person, but on the basis of marital liabilities, the debtor withholds the bank deposit and collect the execution money; after the execution, the party recovers from the other party and obtains support according to the divorce agreement. It is evident that creditors typically enforce their claims by obtaining a court judgment to recognize joint debts or by enforcing execution against the debtor’s share of jointly owned property; any addition of new parties must be based on statutory grounds. 6. Frequently Asked Questions

I have already received the judgment. Can I directly apply to add my spouse as a party during the enforcement phase?

Generally not. Among the circumstances that may give rise to additional liability enumerated in Interpretation [2016] No. 21, “spouse” is not included; the enforcement procedure serves to implement an effective judicial document rather than to determine substantive liability. The correct course of action is to file a separate lawsuit to confirm the marital joint debt, and after obtaining a new enforcement basis, apply for enforcement (which may be consolidated with the original case).

If the house and savings are registered solely in my spouse’s name, can I apply for a lien?

You can give it a try. Property acquired during the marriage, even if registered solely in the name of one spouse, is, in principle, presumed to be jointly owned by the spouses. The court may, pursuant to the provisions on seizure and freezing, seize or freeze such property; however, the other spouse must be promptly notified, and the portion that may be disposed of generally does not exceed one-half of the total value. Whether a seizure can be ordered depends on the leads and the court’s verification results.

My spouse says the divorce agreement stipulates that the other party is solely responsible for the debts. Can this protect them from me?

No. The provisions of a divorce agreement constitute an internal agreement between the spouses and are binding only between them; they cannot be enforced against creditors who are not parties to the marriage (unless such creditors were aware of and consented to the agreement at the time). If one spouse incurs liabilities to third parties, they may seek reimbursement from the other spouse; moreover, if the agreed-upon property division is manifestly unreasonable and prejudices creditors’ rights, creditors may also request the annulment of such agreement or assert its invalidity.

7. Practical Insights from a Lawyer

Many creditors get the result of not being able to execute the property, so they want to apply directly to add the spouse of the other party. This road is basically impassable in practice, and hard walking will only waste several months from filing a case to ruling. A more realistic approach is to first judge whether the things under the spouse's name are common property and whether they belong to the debtor's share, and then choose the path: if the house, car and deposit are acquired within marriage and registered under the spouse's name but belong to the common property of the husband and wife, they can directly claim to execute the share belonging to the executed person in the execution without adding the main body; If the core dispute is whether this debt is a joint debt of husband and wife, it will have to be prosecuted separately and this substantive issue will be left to the trial process. If you choose the wrong direction, no matter how comprehensive your resources are, you’ll only be going in the opposite direction.

When preparing evidence, you need to focus on two aspects: where the money went and where the assets originated. On the side of confirming the common debt, the focus is on the purpose and common benefit of the loan, whether the money has entered the family account, whether it is used for joint operation, whether the spouse enjoys the operating income, whether there is repayment or declaration of post recognition; On the side of implementing the share of common property, the focus is to find out the acquisition time, source of contribution and registration of the property, use registration inquiries, running water, tax or business records to fix this joint acquisition within the marriage. Act promptly—once a spouse transfers the assets again, the costs and difficulties of tracing them will increase dramatically. If you can apply for asset preservation early in the litigation or enforcement proceedings, do not delay it until after the judgment is rendered.

There is another often-overlooked juncture: when a creditor initially sues the debtor, it should assess whether it is necessary to name the debtor’s spouse as a co-defendant. If the joint debt was claimed together in the original lawsuit and the key facts were ascertained in court, there would be no need to make a big circle later. Whether to list the spouse and whether to initiate subrogation-based property division in advance depends on the completeness of the evidence and the time constraints. It is better to verify leads about assets as early as possible than to wait until the enforcement proceedings are officially concluded before scrambling to catch up.

For creditors: when borrowing money, insist on "co-signing debts and leaving traces of use", and try to let the spouse guarantee; If it is considered to be a joint debt when suing, directly list the spouse as a co-defendant; After receiving the judgment only for one party, first check and control the property under the name of the person to be executed, and at the same time actively provide clues to the property under the name of the spouse and apply for sealing up the common property in writing; Find signs of transfer, timely preservation and exercise of cancellation right. On the spouse side: in the face of court seizure, first distinguish the nature of the objection-the lawsuit that advocates personal property to go outside the case to execute the objection, thinks that the execution behavior is illegal to go to the execution behavior objection plus reconsideration, and it is difficult to remedy the missed time point. The outcome of an enforcement action is often sealed the very moment the promissory note is signed.
