Can Ningbo creditors add the debtor's spouse as the executor?

The husband was out in debt, and the court ordered him to repay the debt personally. Once the judgment entered the enforcement stage, the creditor discovered that virtually no assets could be traced under the debtor’s name, yet the family was living in a house registered under the wife’s name and driving the wife’s car. Many creditors in Ningbo often have the same question: Can the debtor’s spouse also be added as a party subject to enforcement, so that their jointly owned property can be subject to execution as well? The answer is twofold— In principle, it can not be added directly, but it can be sued separately to confirm the joint debt of the husband and wife, or apply for the execution of the share of the joint property of the husband and wife under the name of the spouse belonging to the executed person. The former is "this road is blocked", the latter is the right way.

1. Why can't the spouse be directly added during the enforcement phase?

to make clear "can or not", first distinguish one thing: the execution procedure and the execution basis are two different things. The object of compulsory enforcement is the obligor specified in the legally effective document; the task of the enforcement procedure is to realize the rights and obligations determined by the judgment or mediation agreement, rather than to re‑litigate “who should be responsible for this debt.” Adding the person to be executed is tantamount to adding substantive liability to a third party outside the judgment, so the law puts two "locks" on the matter ".

The first lock is "additional legalism". Provisions of the Supreme People's Court on Several Issues Concerning the Alteration and Addition of Parties in Civil Execution (Fa Shi [2016] No. 21, which came into force on December 1, 2016 and is currently effective after the amendment in 2020) list the circumstances of the person subject to execution that can be changed and added one by one: when the property of the enterprise legal person is insufficient to pay off, additional shareholders, contributors or promoters who have not paid or have not paid their capital contributions in full (Article 17), shareholders who have evaded their capital contributions (Article 18), and original shareholders or promoters who have transferred their shares without making capital contributions in accordance with the law (Article 19); If a shareholder of a one-person company cannot prove that the company's property is independent of his own property, the shareholder may be added (Article 20); If the company is canceled without liquidation, additional shareholders, directors and controlling shareholders may be added (Article 21); in addition, there are sole proprietorship investors, general partners, etc. Reading through the full text, it can be found that this list is aimed at shareholders, funders, promoters, partners, liquidation obligors and other subjects that are legally implicated in the debt,From beginning to end, “spouse” was never listed as an eligible party to be added.. The core of the additional legalism is that "nothing can be done without express law". Without a spouse in the list, the executive judge has no room for free play.

The second safeguard is the separation of adjudication and enforcement, along with procedural guarantees. Whether a debt is a joint debt of husband and wife is a typical substantive dispute, involving complex facts such as the purpose of borrowing, whether it exceeds the needs of the family's daily life, whether it is used for joint production and operation, and the law gives the right to judge to the trial procedure. More importantly, the spouse usually does not participate in the original litigation, does not reply, does not cross-examine, and the validity of the effective judgment does not, in principle, extend to the third party who does not participate in the litigation (res judicata relativity); If a ruling in the execution stage turns the spouse into the executed person, it is tantamount to depriving him of his litigation rights in the first, second and even retrial. For this reason, the "Notice of the Supreme People's Court on Issues Concerning the Proper Trial of Cases Involving Marital Debts in accordance with the Law" (Law [2017] No. 48) draws the bottom line:"Without a trial procedure, the spouse who has not borrowed the debt shall not be required to bear civil liability."

The judicial attitude has been unified. The Supreme People's Court (2015) Zhishen Zi No. 111 Executive Ruling (Shanghai Ruixin Hengjie Investment Co., Ltd. and Baoding Mancheng Zhenxing Chemical Factory and Wang Baojun Executive Proposal) clearly states that the addition of the executed person must follow the principle of legalism, and there is no provision in the current laws and judicial interpretations that "the spouse of the executed person may be added in the execution procedure". Creditors requesting the addition on the grounds of substantive rules such as marriage law and judicial interpretation will not be supported. Therefore,During the enforcement phase, it is neither permissible toDetermination "this is a joint debt of the spouses," nor is it appropriate to, on that basis, add the spouse to the list of persons subject to enforcement.. The substantive basis for judging common debts is Article 1064 of the Civil Code: debts expressed by common intention such as joint signature or subsequent ratification and debts incurred for the daily needs of the family are common debts; Generally speaking, debts that exceed the needs of the family's daily life are not joint debts, unless creditors can prove that they are used for the joint life of husband and wife, joint production and operation, or based on the expression of common intention-the determination of this standard must be completed by a lawsuit.

Two correct paths to 2. creditors

Since it can't be added in the execution stage, creditors want to expand the main body of debt repayment, and there are only two right paths left: to hand over the "joint debt of husband and wife" to the trial procedure for settlement, or to move the main body and directly point to the share of the executed person in the common property. The two paths can be parallel.

1. Option 1: File a separate lawsuit to confirm the existence of marital joint debt.

This is a regular way to "pull in" the spouse. The creditor shall, on the ground that the debt determined by the original effective judgment is the joint debt of the husband and wife, sue the debtor's spouse separately, request confirmation of the joint debt and order it to pay off jointly, The cause of the case is "Dispute over the Confirmation of Joint Debt of Husband and Wife". The relevant answer of the Zhejiang Higher People's Court is clear: If the nature of the debt is judged to be a personal debt and the applicant for enforcement has objections, the enforcement agency shall inform it of a separate lawsuit, and the filing department shall accept it.

To win this confirmation lawsuit, proof is the key. According to Article 1064 of the Civil Code, if the loan amount is within the scope of "the needs of the family's daily life", it is determined to be relatively loose. Once it obviously exceeds the daily needs (such as hundreds of thousands or even millions of dollars), the creditor must prove that the loan is used for the husband and wife to live together, produce and operate together, or that there is an indication of the intention of borrowing together. After obtaining a new effective judgment, the creditor will have an enforceable basis and may apply for enforcement with the original case. Compared with trying luck in the execution procedure, it is safe to solve the substantive problems in the trial procedure first.

2. Option two: Do not seek additional enforcement; directly apply for enforcement against the jointly owned property share registered under the spouse’s name.

If the joint debt cannot be confirmed temporarily, or there is obvious joint property of the husband and wife under the name of the spouse, the second way can be taken: the spouse is not required to be listed as the person subject to execution, but the execution court is requested to seal up, seize and freeze the property shared by the person subject to execution and the spouse, and then the compensation is limited to the share of the person subject to execution. Based on Article 14, paragraph 1, of the Provisions of the Supreme People's Court on the Seizure, Seizure and Freezing of Property in Civil Execution by People's Courts:"The people's court may seal up, seize and freeze the property shared by the executed person and other people, and notify the co-owner in time." The second paragraph of this article: If the co-owners agree to divide the common property and the creditors approve it, the court may determine that it is valid, and the shares of other co-owners should be unsealed; the third paragraph: If the co-owners file a property analysis lawsuit, or apply for the executor's subrogation to file a property analysis lawsuit, the court shall allow it, and the execution shall be suspended during the litigation.

A common misconception needs to be clarified: it is not the case that “property division and determination of shares must be completed before enforcement can proceed.” The Supreme People's Court (2017) Supreme Law Minshen No. 2083 Civil Ruling clearly states that the third paragraph above gives the co-owner "to file a property analysis lawsuit" or the applicant "to file a property analysis lawsuit on behalf of the executor". Rights, not obligations; In the case of neither division by agreement nor property analysis litigation, the first paragraph shall be directly applied, and the enforcement court shall have the right to directly dispose of the executed person's share in the common property.

3. how to execute the property in the name of the spouse

takes path two, and the difficulty is "which property can be touched and how much can be touched". The core rules can be broken down into three steps.

Step one: Determine whether the property is marital joint property. The legal property system of husband and wife in our country is the joint system of post-marital income: the salary and bonus, production and operation income, inherited or donated property (except those determined to belong to only one party in the will or gift contract) during the existence of the marriage relationship belong to the husband and wife jointly; the property of one party before marriage, the compensation or compensation for personal injury, the property designated to only belong to one party, etc., belong to the personal property. The key to the judgment is therefore the time of acquisition-property acquired after marriage, even if it is registered in the name of only one spouse, is presumed in principle to be the joint property of the husband and wife. The Supreme People's Court (2018) Supreme Law Minshen No. 2802 Civil Ruling is as follows: the real estate and parking spaces registered in the name of spouse Deng Gexian, which have no evidence to show that they are owned by individuals, shall be deemed as the joint property of husband and wife. The court seizure conforms to Article 14 of the provisions on seizure, seizure and freezing. Spouses do not enjoy civil rights and interests sufficient to exclude enforcement of the real estate.

The second step is to determine the share of the executed person. General grasp: the share shall be subject to registration and publicity; if there is no registration and publicity, it shall be determined according to the amount of capital contribution; if the amount of capital contribution cannot be determined, it shall be regarded as equal. In principle, the joint property under the name of the spouse and the name of both spouses shall be executed within the 1/2 share, and the remaining part shall be returned to the spouse; the execution share shall not exceed 1/2 unless the spouse expressly agrees. What the creditor can get is the half of the common property of the executed person, not the whole property.

The third step is to determine the disposal method.Generally, physical division is attempted first; if physical division is not feasible or would significantly diminish the asset’s value, the court may dispose of the entire asset as a whole (most commonly in the case of real estate), then allocate the portion belonging to the judgment debtor from the proceeds of the sale for debt repayment, with the remainder returned to the spouse.

An operating premise: if the spouse is not the person subject to enforcement in this case, the court's regular investigation and control system generally will not take the initiative to investigate the property under his name, and the enforcement judge usually will not take the initiative to intervene. Therefore The executor must take the initiative to provide property clues(property registration, vehicle, bank account trail, etc.), and apply for seizure in writing. Before taking measures, the court will check whether "it is indeed the spouse of the person subject to execution" and "whether the property was acquired during the marriage"; if it is verified that it is the personal property of the spouse (e. g. the property was purchased before the marriage), it will generally not be executed.

How 4. Spouses Defend: Two Remedies and Three Grounds

After the property is sealed up, the spouse can not only accept it passively, but choose the relief channel depending on the nature of the objection.

First, the outsider's objection plus the outsider's execution of the objection. If the spouse thinks that the seized property is his own personal property, not common property, and belongs to the substantive right of the subject matter of execution, he can submit a written objection according to the provisions of the Civil Procedure Law on the objection of outsiders (the current article 234, the original article 227); if rejected, he can file a lawsuit for the objection of outsiders within 15 days from the date of service of the ruling, confirmation of ownership through an entity hearing to exclude enforcement.

Secondly, an objection to the enforcement action followed by a reconsideration. The spouse has no objection to the property being common property, but thinks that the court should not take enforcement measures against the property, or thinks that the enforcement act is illegal, which is an objection to the enforcement act, and can submit a written objection according to the current Article 232 of the Civil Procedure Law (former Article 225). If you are not satisfied, you can apply to the higher court for reconsideration within

10days.

For substantive defences, spouses usually have three reasons:(1) Property is personal property-- if it is acquired before marriage, or if it belongs to the individual due to inheritance or donation, or if it is the compensation for personal injury, it claims to exclude execution accordingly;(2) The debt is the personal debt of the other party.-- Proof that the loan is not used in the daily life of the family, not used in common life or common production and operation, and I have no intention of borrowing together;(3) Debt is illegitimate debt-- The debts incurred due to illegal and criminal activities such as gambling and drug taking are not protected, and the creditors still lend money knowing it. It should be reminded that the divorce agreement or marital property agreement is an internal agreement, only binding the husband and wife, can not fight the bona fide creditors.

(example, fictitious) For example, Mr. Zhang in Ningbo borrowed 800000 yuan in his marriage but was not used for his family. Ms. Wang, his spouse, claimed that the sealed-up property registered in his name before marriage was personal property, and filed a lawsuit of objection to execution by outsiders. The court found out that the property was indeed purchased before marriage and there was no joint repayment of the loan, and the judgment supported the exclusion of execution. This example is only used to illustrate the relief path, not the real case.

Precaution of 5. creditors: putting effort into borrowing

Instead of struggling with "whether or not to add a spouse" in the implementation stage, it is better to block the risk when borrowing and trading. A few of the most practical pre-arrangements:

  1. Co-Debt Co-Signed. Large loans or major transactions, requiring the debtor's husband and wife to jointly sign the debit note, contract, repayment commitment, or let the spouse issue a joint repayment commitment, after-the-fact written recognition, in advance fixed "husband and wife joint debt" evidence. This is the most effective move under Article 1064 of the Civil Code.
  2. Use mark. The purpose of the loan is stated in the contract, the loan is transferred to the agreed account as far as possible, and the fund flow voucher is retained, so that it can be proved to be used for the husband and wife to live together or to produce and operate together in the future.
  3. Additional Guarantees. The spouse is required to provide a guarantee or to create a mortgage on the property or vehicle in the couple's name, and the liability for the guarantee remains valid even if the debt is recognized as a personal debt.
  4. The spouse is listed as a co-defendant at the stage of the proceedings. If it is considered to be a joint debt at the time of prosecution, try to directly list the spouse as the defendant together, instead of waiting for the judgment against only one party and then turning back to fill the gaps.
  5. Retention of property clues and preservation in due course. In the transaction, pay attention to the property, vehicle and equity clues in the name of the other spouse, and apply for preservation in time when the transfer of property is found.
  6. Propose in time and do not delay the time limit. There are time limits for confirming joint debts, exercising the right of revocation, and applying for enforcement; once any relevant clues are discovered, action should be taken as soon as possible.

class case reference: in the execution, the debtor's spouse is not directly added as the person subject to execution, but withholding the deposit and collecting the execution money from the borrowing party on the basis of the marital liabilities, which party will recover the compensation from the other party according to the divorce agreement after the performance. It can be seen that there is no legal basis for additional spouses, and creditors often realize their claims through trial to confirm joint debts or to enforce their share of common property. 6. FAQ

I have received the judgment, can I directly apply for additional spouse at the execution stage?

Generally not. There is no "spouse" in the additional circumstances listed in the interpretation of the law [2016] No. 21, the implementation procedure is the implementation of the effective instrument rather than the confirmation of entity responsibility, and the direct addition of the violation of the additional statutory doctrine will also be corrected by the higher court. The correct approach is to file a separate lawsuit for the confirmation of the joint debt of the husband and wife, and then apply for execution after obtaining a new basis for execution (can be combined with the original case).

The house is registered in the name of a spouse, can I apply for seizure?

You can give it a try. The real estate acquired during the marriage, even if it is only registered in the name of one spouse, is still presumed to be the joint property of husband and wife in principle. The court may seal up in accordance with Article 14 of the provisions on seizure, seizure and freezing, but the spouse shall be notified in time, and only the share of the executed person in the joint property can be disposed of (in principle, no more than 1/2). Whether a seizure can be ordered depends on the leads and the court’s verification results.

My spouse says the divorce agreement stipulates that the other party is solely responsible for the debts. Can this protect them from me?

No. The provisions in a divorce agreement regarding the allocation of debts and division of property constitute an internal agreement between the spouses and are only binding as between them; they cannot be enforced against creditors who are not parties to the marriage (unless such creditors were aware of and consented to the arrangement at the time). After one spouse has assumed liability to a third party, they may seek reimbursement from the other spouse pursuant to their agreement.

If a spouse argues, “I didn’t spend the money,” does this defense necessarily hold?

Not necessarily. It depends on the type of debt: if the amount is within the scope of the daily needs of the family, it can generally be directly identified as a joint debt, and whether the spouse personally handles it does not affect it. The "record of the loan's intended use" at the time of borrowing is far more important than any subsequent disputes.

7. Practical Insights from a Lawyer

During the enforcement phase, many creditors’ most straightforward approach is to apply to have the debtor’s spouse also designated as an enforced party. However, based on our experience in handling cases, this approach is usually unsuccessful, as there is a clearly defined statutory list of circumstances under which the judgment debtor may be changed or added; a spouse is not included in that list. The enforcement procedure is solely responsible for implementing the content already determined in the final and effective legal document; it does not re‑determine whether a particular debt constitutes joint marital debt. The latter constitutes a substantive dispute and must be resolved within the trial proceedings. So don’t waste your time and application effort on adding a spouse; shifting your focus to another approach may actually make it easier to move forward. First accept this premise, and then discuss feasible approaches—only then will you avoid wasting your energy on the wrong things from the outset.

There are two feasible ways, one is to sue separately and request to confirm that the debt is the joint debt of husband and wife, and the other is to apply for execution on the part of the debtor's share of the joint property of husband and wife under the name of the spouse. Both approaches rely on evidence, with the focus directed toward three key areas: whether the loan was used for shared living expenses or joint business operations; whether the funds were deposited into accounts controlled by or jointly used by the spouse; and whether household expenditures coincide in time with the incurrence of the debt. Before a case is officially opened, organizing these leads into a clear financial trail is far more effective than simply piling up a bunch of unrelated transfer screenshots. You also need to assess the cost‑benefit ratio: litigation takes time, and enforcement entails costs. First, calculate everything clearly before deciding which avenue to pursue.

The opposing spouse’s defenses typically focus on three points: this is the debtor’s personal debt, they were never involved and are unaware of how it was used, and the funds were not applied to household expenses. Creditors should prepare rebuttal materials in advance rather than responding on the spot. A more fundamental reminder is that precautions should be taken at the time of borrowing: having the spouses sign together, the contract stating the purpose, and the money going into a joint account or indicating that it will be used for family business, these actions at that time are much more convenient than making great efforts to prove them afterwards. It’s not until the enforcement stage that one discovers there are no assets under the other party’s name. In fact, much of the initiative was already relinquished at the moment the loan was disbursed; subsequent debt collection is merely a form of remedial action.
