The 16 types of property that are most likely to be missed in divorce in Ningbo: the self-examination list of family assets
To put it bluntly: when it comes to divorce, the assets most likely to be overlooked are never houses, cars, or bank deposits—rather, they are the “invisible, not yet received, or held in someone else’s name” types of modern assets, including housing provident fund, corporate pension plans, stock options, nominee‑held equity, social media accounts, virtual currencies, the cash value of insurance policies, and external receivables. Missing just one of these can mean forfeiting real money.
A family law team, after analyzing the cases it has handled, found that 92% of divorce cases involve undivided marital property. Everyone will check houses, cars, and deposits. These 16 categories are the most concealed and are most likely to be "passed over".
The same is true in Ningbo: Ningbo Housing Provident Fund Management Center settled 1.402 billion yuan for the city's 3.13 million employees in 2024 (source: official website of Ningbo Housing and Construction Bureau); With the addition of enterprise annuity, equity incentive and online store self-media income, family property has long been more than housing, car and deposit.
In this paper, 16 types of assets are divided into four groups, each type of clear legal attributes, segmentation methods, discovery channels, and give a self-examination-investigation-preservation of the three-step path, it is recommended to collect after the control of self-examination.
1. Why is there always "missing division" in divorces?
There are two major root causes and three types of misunderstandings.
Root cause one: property form "from real to virtual".Article 1062 of the Civil Code: Wages obtained during marriage, income from business investments, etc., are by default jointly owned by the husband and wife, regardless of who contributes. Real estate is registered, bank deposits have transaction records, yet the housing provident fund remains in an “invisible account”; stock options are not recognized as assets until exercised; nominee-held equity cannot be traced back to the individual; and virtual currencies exist on the blockchain, while cash withdrawals leave no trace— the more “virtual” the asset, the easier it is to evade detection.
Root cause two: information asymmetry within the family. Most families have one party in charge of the money, while the other party (especially the full-time party) does not know the full picture of the assets. Banks and platforms only open information to themselves-individuals cannot check their spouse's property, which is why judicial investigation must be carried out.
Three types of misunderstandings make the missing points worse:
- Myth 1: "Money you don't get is not money."Positive: They are the consideration of labor and business within marriage, which are common property whenever issued, and are discounted at most for the duration of the marriage.
- Myth 2: "Whoever is registered in his name is his."Positive solution: registration is only the appearance, the source of capital contribution is the key to penetrate the identification.
- Myth 3: "What is invisible is personal."Positive solution: provident funds, annuities, virtual assets acquired in marriage are part of the common property.
2. 16 categories of assets are disassembled on a class-by-class basis.
The following are disassembled in four groups of 16 categories, which are common rules and mainstream practices, and the determination of individual cases varies depending on the time of acquisition and the source of funding.
The first group of "invisible money": provident funds, annuities, social security and cash hiding.
1. Housing accumulation fund.Legal attributes: Article 25 of the Interpretation (I) on Marriage and Family clearly states that the common property of the public reserve metal actually acquired or should be acquired during marriage shall be included in the interest. Division method: according to the marital deposit of principal and interest balance division, has been extracted by running water calculation. Discovery channels: I check Zheli Office or "National Housing Provident Fund" small program; The other party's account needs to apply for an investigation order in the lawsuit.
2. Enterprise annuities, occupational annuities and personal pensions.Legal attributes: the annuity account contributions and income of marital units and individuals are common property (deferred labor remuneration). Method of division: divide based on the amount accumulated during the marriage or by converting it to a cash value. As annuities are typically payable upon retirement, some courts refrain from addressing such cases for the time being until the relevant conditions are met, and first clarify the applicable practice of the court having jurisdiction. Discovery channels: annual statement of the unit, personal pension area of the bank where the account is opened.
3. Social security funds such as basic old-age insurance.Legal attributes: Article 25 of the (I) of Interpretation lists "basic pensions actually obtained or should be obtained" as common property. Method of division: For benefits already received, they are divided directly; for those not yet retired, regarding the portion contributed to the individual account during the marriage, some courts support dividing it, while others hold that such claims should be made after the benefits are actually received. Source of discovery: the “Social Security” module on the Zhejiang Government Services App; the relevant details were obtained from the social security administration agency pursuant to an investigation order.
4. Cash stash and "in vitro" funds.Legal attributes: cash from marital income and funds transferred to other people's accounts and escrow are still common property. Division method: It is difficult to prove “assets acquired during marriage—abnormal disposition—still under the other party’s control”; however, large, frequent cash withdrawals shortly before divorce are subject to strict judicial scrutiny. Discovery channels: wage entry and cash withdrawal flow comparison, cash gap, relatives holding clues. For example, one party withdrew RMB 400,000 in cash on more than ten separate occasions prior to the divorce and could not account for its use; the court determined that this constituted an attempt to transfer assets—where, with respect to cash, documented evidence carries greater weight than the need to trace its specific destination.
The second group, "money in the company": equity holdings, options and corporate dividends.
5. The right to hold shares on behalf.Legal attributes: the marriage with common property capital contribution, registered in the name of parents and friends of the equity, the corresponding rights and interests of the capital contribution belongs to the common property. Method of division: Conduct a “look-through” analysis by examining the fund flow records, nominee agreement, and distribution of dividends; then proceed with either a discount based on the appraised value or an allocation of shares. Discovery channels: only names can be found in industrial and commercial registration, and the establishment of capital contribution and dividend transfer over the years must be checked. First check the position and operation in the publicity system.
6. Options, Restricted Stock and RSUs.Legal attributes: look at the time of grant and attribution, not the time of exercise release-part of the grant or attribution within marriage is common property, and the release of the ban after divorce is only delayed (Fujian Ningde Jiaocheng Court 2025 case, source: Fujian Rule of Law Network). Division: Negotiate a discount based on quantity or percentage of proceeds, or order to pay a discount based on marital vesting after realization. Discovery channels: incentive agreements, company announcements, and individual income tax records (vesting is taxed as wages and salaries, which can serve as a lead). Ningbo has a large number of listed companies, yet this value is often underestimated.
7. Company dividends, undistributed profits and year-end bonuses, commissions.Legal attribute: dividends from married companies belong to "production and operation income" (item 2 of article 1062 of the civil code); Year-end bonus and commission are marital labor remuneration, which are converted according to the marital period after divorce. "No dividend" does not mean no profit. Dividing method: the direct distribution of the account has been received; The undistributed conversion or agreed recovery after another claim; The company's profit retention can apply for audit. Discovery channels: salary and year-end bonus flow, tax return, dividend resolution, company and personal account flow.
The third group of "digital assets": virtual currency, self-media, online stores and virtual goods.
8. Virtual currency.Legal attributes: Article 127 of the Civil Code protects online virtual property; virtual currency has no legal status in the territory, transactions are controlled, but the value of the property has been judicially recognized, and the purchase of the property is divisible (the prohibition only affects the realization, not the property). Split: Discount on the number of holdings and a written fixed valuation, or half of each wallet share. Discovery channels: exchange accounts, transfers to the platform, wallet addresses and mnemonic clues-"off-chain traces" are the only gripper.
9. From the media account.Legal attributes: marital registration and operation, commercial value of the account, the proceeds and account value belong to the common property. Method of division: Compensation based on the appraised value after entrusting an appraisal — in the case involving a Douyin account with over one million followers handled by the Xiangyin People’s Court in Hunan, the asset was valued at over one million yuan prior to its disposition (Source: China Economic Net). Discovery channels: backend fan revenue data, MCN contracts, advertising quotes, and e-commerce commission settlement records.
10. The right to operate the online store.Legal attributes: the core value of the online store is the management right and the store credit (star, goodwill, supply chain, credit, customer base), not the balance. Method of division: The continuing operator shall provide monetary compensation; the value can be assessed. Under the platform’s real-name registration rules, transfers are restricted, so compensation is the primary approach. Discovery channels: merchant backend data, Alipay transaction records, and supply contracts—Ningbo’s cross-border e‑commerce sector is highly developed, and it is common in the industrial cluster for husband-and-wife teams to jointly operate online stores.
11. Game account and virtual props.Legal attributes: account number, skin, rare equipment, limited card with market value, is a network virtual property, practice generally supports the market discount (Ningbo Yinzhou Court White Paper has listed such new property). Method of division: Under the real-name registration system, it is generally allocated to the registrant, who shall compensate the other party. Discovery channels: recharge records, game transaction records, trading platform valuation-large recharge is the best evidence.
12. Digital collections and high-priced membership rights.Legal attributes: NFT digital collection, transferable high-end membership, airline hotel points have use and transfer value. Method of division: Valuation based on the remaining value or the transfer price; non-transferable assets to be negotiated. Discovery channels: purchase receipts, membership contracts, and points statements.
The fourth group "future income": debt, insurance, intellectual property and live reward.
13. Claims (accounts receivable, loans and advances).Legal attributes: money lent within marriage, company receivables, project advances are common property. Methods of division: divide the claim itself, agree on the allocation of collected funds, or provide compensation at a discounted value; pay attention to the statute of limitations and collection‑related evidence. Discovery channels: IOUs, contracts, collection records, loan flow.
14. Cash value of insurance.Legal attributes: wealth management, annuity insurance and life insurance with cash value insured with common property during marriage, cash value belongs to common property. Method of division: Surrendering the policy results in a loss of cash value; commonly, one party keeps the policy while the other receives half of its cash value. Discovery channels: original policy documents, renewal premium payment records; pure protection-type insurance policies have low cash value and are generally not subject to division.
15. Intellectual property rights and their future earnings.Legal Attributes: Article 24 of the (I) of Interpretation: Intellectual Property Income refers to the property income actually obtained or clearly obtainable during marriage-royalties from marital creation and divorce can be claimed. How to divide: points that have been paid; claims that have been signed but not paid; claims that are only expected to be paid. Discovery channels: copyright patent certificates, licensing agreements, royalty reports, and technology-investment agreements.
16. Live reward income.Legal attributes: marital live broadcast, with goods received reward and settlement income is a common property, the spouse concealed from the other party a large amount of reward anchor, obviously beyond the level of family consumption, according to the "marriage and family interpretation (II)" article 6 can be identified as "squandering". Division method: The former is divided as joint property; the latter may, pursuant to Article 1066 of the Civil Code, claim division during marriage, or, upon divorce, claim that the gifting party receives a smaller share or no share at all; for gifts given in connection with extramarital affairs, restitution may be claimed pursuant to Article 7 of Interpretation (II). Discovery channel: Platform settlements and tipping revenue.
3. Discovery Path: Three-step Self-examination
The new property game, the competition "can be found, locked", three steps:
1. Checklist: First do the "Household Assets Survey"
Before prosecution or negotiation, check the 16 categories one by one and solve the "have or not" first ". Materials are collected into five categories: Compensation and Benefits (pay stubs, bank statements, year-end bonus records, screenshots of housing fund, social security, and pension contributions); Business Rights and Interests (company registration details, shareholder registry, dividend proxy payment records, intellectual property certificates); Financial Assets (insurance policies, securities and wealth management products, virtual currencies, personal pension records); Digital Assets (backends of self-media platforms and online stores, game top-ups, membership credentials); and Creditor’s Rights (loan agreements, contracts, debt collection records). Take screenshots of each item as evidence.
2. Judicial investigation: turning "not found" into "found"
There are three legal channels when the other party does not cooperate: one is to apply for property declaration-the court orders both parties to truthfully declare all their property, and to conceal and verify that there is less or no difference (Article 1092 of the Civil Code); Ningbo Yinzhou Court implemented divorce property declaration. The second is to apply for a lawyer's investigation order-Zhejiang High Court has tried out and standardized the system (Zhejiang High Law [2018] No. 109). Lawyers can obtain bank, securities, insurance, provident fund, municipal supervision, taxation and platform information by order. Third, apply for court access and special audit, the last three to five years of water penetration verification, identification of holding capital contributions, financial insurance, virtual currency, withholding profits and other abnormal funds to go.
3. Property preservation: "lock up" before the other party does it"
Stocks can be sold in a few minutes, online stores can be transferred in a day, and shares can be changed in a few days. Assess the risk of asset transfer prior to or concurrently with filing a lawsuit; for applications involving such risks, seek to freeze accounts and seize equity interests—provisional measures require security but can ensure the enforceability of the judgment. Preservation of evidence must be conducted through the court; privately freezing accounts or logging into another party’s account constitutes unlawful evidence collection.
Remedy after 4. missed points: can be divided again after divorce
After the agreement or judgment came into effect, the missing points were discovered. The law gave two channels:
- Re-division (for concealment, transfer):According to Article 1092 of the Civil Code, if the other party is found to be hiding or transferring common property, it may sue for re-division and claim less or no division; the limitation period is three years, counting from the date of discovery (Article 84 of the (I) of Interpretation).
- Division of undisposed property (for omission by both parties):According to Article 83 of the Interpretation (I), common property not involved in the divorce may be divided again without proof of bad faith-"delayed arrival" assets such as option release funds, insurance cash value, claims recovery funds, etc. are particularly applicable.
Agreed divorce should pay attention to the bottom-up clause: "No other property dispute" cannot exempt the other party from concealment responsibility; Voluntary waiver of irrevocability; Under fraudulent coercion, the property division clause may be revoked, and the right of revocation may be revoked for one year (Article 1
52of the Civil Code).
Reference to similar cases: In the case of property disputes after the divorce between Jin and Zhang, the court determined that the office space, car and bank deposits not involved in the divorce agreement were common property that was not processed at the time of the divorce. After the divorce, the division can still be requested. The defense raised by "one year has passed" is not tenable. It is evident that undivided assets such as housing provident fund, equity interests, and external claims may be separately claimed for division upon discovery. Trial Court: Intermediate People’s Court of Ningbo City, Zhejiang Province Case No.: (2014) Zhe Yong Min Yi Zhong Zi No. 478
5. FAQ
Provident fund has not been taken out, can divorce be divided?
Yes. The principal and interest contributed during marriage constitute joint property; if any portion is overlooked, it may still be claimed separately after divorce pursuant to Article 83 of the "Interpretation (I)," with a three-year statute of limitations commencing from the date of discovery.
During a divorce, if the stock options have not yet been exercised and the company has not yet gone public, can they be divided?
Yes. Focus on the grant and vesting dates, not the liquidity event; you can agree to a proportional distribution or discounted compensation upon liquidity, but do not rashly waive your rights in the agreement.
If a spouse spends hundreds of thousands on tipping streamers during the marriage, can the money be recovered?
amount of money. Rewards that obviously exceed the level of household consumption are "profligacy" (Article 6 of the Interpretation (II)), and they are claimed to be less or not divided at the time of divorce. Accompanied by extramarital affairs, according to Article 7 of the Interpretation (II), the return is claimed.
The agreement states “no other property disputes”; can it still be revoked?
The concealed property is not exempt and can be divided again; the voluntary waiver must prove fraud and coercion (the right of revocation is one year). Before signing, first conduct a self-check against the 16-category checklist.
In Ningbo, where can I check my housing provident fund and occupational pension?
I: The provident fund is run in Zhejiang or the "National Housing Provident Fund" small program, the pension account is run in Zhejiang, the social security module is run, the personal pension is in the bank area where the account is opened, and the enterprise annuity is asked about the personnel of the unit. Information pertaining to third parties may only be obtained through an investigation order or by court request.
6. Practical Insights from a Lawyer
When handling cases of this type, the first thing lawyers often correct is the client’s statement: “My family only owns one house and a small amount of savings.” From the experience of handling cases, it is precisely those assets that are "invisible, not yet in the account, and recorded in the name of others": provident fund, enterprise annuity, unexercised options, holding rights, insurance cash value, platform account income, external claims and so on. They usually keep a low profile; once they’re casually dismissed, it’s real market share that gets given up. Therefore, when thinking about divorce, the first thing to do is not to talk about the conditions in a hurry, but to make a list of family assets as complete as possible, and write down the source of each item, the time of acquisition, the name of whom it is registered, and the approximate amount. This list is the draft for later negotiations and litigation.
Self-examination can only reach "I think there may be", and it usually depends on three legs to really put hidden assets on paper. One is to find out the clues first, such as the provident fund, social security, bank and securities accounts under my name, as well as the contracts, statements, insurance policies and equity documents that can be found at home. The second is to issue an investigation order or apply for investigation and evidence collection in the lawsuit to banks, provident fund centers, securities dealers, insurance companies, etc. once the clues are clear, timely application for property preservation, the other party may transfer the part of the first fixed. The rhythm of these three steps is very important. The sooner the clues are clear and the sooner the security is in place, the smaller the space for the other party to move.
Even if you have already divorced and later discover that certain assets were overlooked at the time, it does not necessarily mean that “the deed is done.” The law has left a successor to this situation. If the other party is found to hide, transfer or sell the common property after divorce, it can apply for division in another case. However, there is a time limit for the claim. From the date of discovery, the longer the delay, the more passive it will be. Therefore, once under-allocation is detected, the relevant clues should be promptly documented and the necessary procedures initiated to prevent the other party from further disposing of the assets as time passes. In practice, it should also be reminded that the premise of division is to prove the existence and ownership of this part of the property, so after finding clues, we should first save the evidence and then talk about division. We should not argue with the other party repeatedly based on oral claims and consume the initiative.
Each of the 16 asset categories has a corresponding account, contract, or transaction record. The cost of leakage is high: remedy requires a second lawsuit, re-proof of evidence, and a race against time limits-leakage prevention is always better than leakage pursuit.
The action suggestion has only three sentences: if you are still married, you can check the list of 16 categories while the relationship is still in place, and keep important account information on file; if you are going to divorce by agreement, write 16 categories item by item into the agreement, rather than write "no other property disputes"; if you are going to divorce by lawsuit, you should complete the property declaration, investigation order and preservation at the same time. Only when everything is thoroughly identified, securely locked down, and clearly categorized can fairness be ensured.
