How to divide the property added after marriage in Ningbo.

After marriage in the other side of the pre-marital property to add their own name, divorce can be divided? This is Ningbo divorce counseling in the high frequency of the problem. The conclusion first says: the name addition after marriage is a gift from the property owner to the other party. After the registration of the change is completed, the house is converted from personal property to joint property of husband and wife, and can be divided in principle during divorce. However, "divisible" does not mean "one person and one half"-registered as shared shares and stated shares, registered as shared shares without agreed shares, the court will determine the proportion by taking into account factors such as the source of the contribution, the contribution to the loan, the length of the marriage, the child support and the fault, and the party with the largest contribution may get a higher share. This paper combines the Civil Code and the interpretation (II) of marriage and family in 2025 to explain the rules of division of named properties.

The legal nature of 1. addition: gift plus registration, and the transfer of rights.

The essence of the addition is that the owner of the house will give part (or all) of the share of property rights to the other party and register the change of real estate. Two elements are indispensable: the meaning of the gift + the completion of registration. If a name is added to the house register, the gift will be fulfilled and the house will enter the joint property of the husband and wife. If there is only an oral promise or a written agreement and the name addition registration has not been handled all the time, the gift has not been completed. In case of divorce, Article 5 of the interpretation (II) stipulates that before marriage or during the existence of the marriage relationship, the parties agree to transfer and register the house owned by one party to the other party or both parties, and the ownership has not yet, if the two parties have disputes over the ownership or division of the house and the negotiation fails, the people's court may, in combination with the purpose of giving, comprehensively consider the duration of the marriage relationship, the situation of living together and the birth of common children, the fault of divorce, the contribution to the family and the market price of the house at the time of divorce, decide that the house belongs to one of the parties, and determine whether to compensate and the amount of compensation, the house may be decided to belong to the giving party, only for appropriate compensation.

In short: if the name is added, it is "true common ownership"; if the name is not added, it is just a "blank cheque". The court will measure whether to compensate and how much to give according to Article 5 of the (II) of Interpretation-under the circumstances of short marriage age, no children and no fault, it is difficult to convert the promise of untransferred ownership into half of the property right. This is also why the agreement agreed that "the property is owned by both parties", must be registered as soon as possible.

Disputes over "house washing" need to be viewed objectively: if one party marries with a name added and demands to split half of the property rights within a short period of time after marriage, the house is actually shared as long as the registration is completed, but the court is not a mechanical half-to-half when the division is made-the second paragraph of article 5 of the interpretation (II) is precisely aimed at the situation where "the marriage lasts for a short period of time and the giving party has no major fault", allowing the giving party, if the joint property of the husband and wife is hidden, transferred, sold, destroyed or squandered, or the joint debt of the husband and wife is forged in an attempt to encroach on the property of the other party, it may be divided less or not at the time of divorce and division. "Adding a name and leaving" for the purpose of defrauding property is judicially bound by the above-mentioned rules.

2. division rules: agreement priority, according to registration, no agreement to see the contribution.

The divorce division of the name-added property is divided into three layers:

  1. agreement takes precedence. If the two parties reach an agreement on the ownership and compensation of the house, it shall be dealt with according to the agreement (Article 1087, paragraph 1, of the Civil Code: the common property of the husband and wife shall be dealt with by agreement in the event of divorce). If the divorce agreement states that "the house belongs to the woman and the man receives a discount of X yuan", the clause shall be binding on both parties after the divorce is registered.
  2. Registered as shared by share, divided by share. If the name is added and it is stated in the register that "the share is shared and the woman accounts for 50% (or other proportion)", the divorce is generally divided directly according to the registered share, unless it can be proved that the registration is not a true expression of intention. This is also the reason why "share at the time of name addition" is the most valuable-turning an uncertain "contribution trade-off" into a definite "share".
  3. If the registration is a common unagreed share, the combined contribution is divided. Most of the additional names are registered as "joint ownership". At the time of divorce, the court determines the proportion according to the principle of "taking care of the rights and interests of children, women and innocent parties" and combining factors such as the source of the house (personal real estate before marriage or joint contribution after marriage), contribution of capital contribution (who pays down payment, who pays back the loan, who invests in decoration), the length of marriage, whether there are children or not, divorce fault and other factors. If the name of the pre-marital property is added, the original funder of the property right usually advocates a higher proportion, and the court will also consider its contribution, but it will not simply "how much is the contribution"-the name-adding gift itself changes the ownership, but the proportion will tilt to the party that contributes more.

It can be remembered like this: adding names turns "whose house belongs" into the question of "how to divide the house"; The answer to "how to divide" is written in the register (by copy), the agreement (agreement) and the contribution account (no agreement).

3. repayment, renovation and transfer taxes: three accounts before and after adding names

repayment of loan account. If the house is a pre-marital mortgage and a post-marital name addition, the repayment funds before and after the name addition are mixed, and the "pre-marital personal repayment part" and the "post-marital joint repayment part" should be separated during the division: the principal and interest repaid by the property owner's personal property before marriage and the corresponding appreciation belong to their personal property; After marriage (including the name addition), the joint repayment part and the corresponding appreciation belong to common property and are included in the division. The Ningbo Court has a reference caliber of "value-added index x joint repayment/2" for such compensation.

Decoration account. The investment in joint decoration after adding the name is a joint investment, which can be included in the contribution when divided; the personal decoration investment before adding the name generally does not change the ownership of the house, only for residual value compensation consideration (see the topic of decoration investment for details).

Tax account. During the existence of the marriage relationship, the change of ownership of the house between husband and wife (plus name) is exempted from deed tax, which is a unified national policy. To apply for name addition, you need to provide materials such as ID card, marriage certificate, real estate certificate, and common situation agreement (in copies or jointly shared), which shall be subject to the requirements of the registration agency.

4. Common Misunderstandings and Risk Tips

myth 1: Add a name is equal to half a person. Error. The house after the addition is a common property, but the proportion of division is determined by the agreement, the registered share or the court's comprehensive judgment, and the party with a large contribution and a long marriage may receive more ".

Misunderstanding 2: As long as the oral promise is added, the house will be half of me. Error. If the gift is not performed before the registration is not completed, the court shall deal with it according to Article 5 of the (II) of interpretation at the time of divorce. In the case of short marriage age and no major fault, the house may be awarded to the giver, only for appropriate compensation.

Myth 3: I can't help it when the other party sells the house without authorization after adding the name. Error. After the house is shared, the unauthorized disposition of the common property must be approved by the co-owner; if it is registered as a common share, one party's separate sale may constitute no right to dispose of it, and the other party may claim rights under certain conditions; but if the buyer has acquired it in good faith and has transferred the ownership, it can only recover from the unauthorized disposition party. It is recommended that the co-owners jointly keep the warrant or register the objection and the co-ownership.

Myth 4: hide the transfer of housing, divorce can also be divided equally. Error. Article 1092 of the Civil Code makes it clear that a party who hides, transfers, sells, destroys or squanders common property may be divided less or not at the time of divorce and division; those found after divorce may be sued for division again.

5. to calculate an account: the division calculation after adding names.

Using numbers to demonstrate "how to divide after adding names" is much more intuitive than abstract rules:

before marriage, the man bought the house worth 3 million yuan in full and registered his personal name. After marriage, he added the woman's name (registered as a common share and unagreed share). He lived together for eight years and had a son. At the time of divorce, the market value of the house was 5 million yuan. Division considerations: the value-added 2 million yuan of the house is a natural value-added, but the value-added part enters the division pool because it has been added to the common property. The court finally decided that the house belongs to the man, and the man compensates 35% of the value of the woman's house, that is, 1.75 million yuan (the proportion is only for indication, and the court actually decides comprehensively). If the name was added at the time of registration as a share, each accounting for 50%, then the basis of division is the share-the woman can in principle divide 2.5 million yuan or discount money; If the marriage lasts for a short period of time (such as one year) and the man has no major fault, according to the spirit of Article 5 of the Interpretation (II), even if the name has been added, the court may also decide that the house belongs to the man and only gives the woman less compensation (e. g. in terms of inputs and contributions during the period of living together).

The same house, due to the "registration share, marriage age, children, fault, contribution" different, the result of the division can fluctuate greatly from "close to half" to "only a small amount of compensation. This is the truth of the division of the name-adding property: the name-adding is only a "ticket", and the share is the result of comprehensive discretion. The calculation suggestion to the parties concerned: first confirm the record in the register (by share or common share), then take stock of the contribution and loan repayment contribution, marriage age and children, and estimate the expected interval of the party according to the framework of "contribution-oriented and care-assisted.

In addition, details related to the "second marriage family" should be suggested: after remarriage, the name of the spouse's premarital property is added, involving the inheritance rights and interests of the children of the former marriage (the house may become part of the estate, and the children of the former marriage have the inheritance right to the share of the investor). Before disposition, the property inheritance arrangement should be considered as a whole, and if necessary, the overall planning of the will and agreement should be coordinated to avoid the chain reaction of "adding name to the current and the agreement.

Reference to Class Cases: In the case of property dispute after divorce between Zhang 1 and Zhang 2, the house involved was registered as a joint property of husband and wife after marriage. The court determined that it was the joint property of husband and wife and confirmed that both parties enjoyed 50% of the shares. It can be seen that the essence of name addition after marriage is gift and registration, after the completion of the change of registration of the house is converted from personal property to common property, but "can be divided" is not equal to "one person and half", the specific proportion will still be combined with capital contribution, loan repayment and other factors to determine. 6. FAQ

is the property added after marriage necessarily divided 50-50 in divorce?

Not necessarily. The registration is divided by share, and if the share is not agreed upon, the court determines the proportion by combining the source of capital contribution, loan repayment contribution, age of marriage, children and fault, and the original contributor may receive a higher share.

How to agree on the safest share when adding names?

In the real estate registration directly choose "by share" and fill in their respective shares (such as 50% each, or according to the contribution of other proportion agreed), the meaning is fixed in the register.

The house still has a loan, can you add a name?

With the consent of the lending bank, some banks require the settlement of the loan or reassessment.

What if the other party secretly sells the house after adding the name?

If the common house is sold without authorization, if the buyer acquires it in good faith and has transferred the ownership, he may claim compensation from the unauthorized disposition party; if the ownership has not been transferred, he may claim that the contract of sale is invalid or refuse to cooperate. It is recommended to update the register in a timely manner after the addition of the name, to jointly keep the certificate, and to apply for objection registration if necessary.

How will the house be sentenced to divorce soon after the name is added?

Look at the age of marriage and whether there are children at fault. Even if the registration of name addition has been completed, if the marriage lasts for a short period of time and the giving party has no major fault, according to the second paragraph of Article 5 of the (II) of interpretation, the court may decide that the house belongs to the giving party, and only determine whether to give appropriate compensation to the other party in combination with living together, giving birth to children, fault, contribution and market price-"name addition is divided into half" is not valid in the short marriage scene; If it is only oral commitment, it is treated in accordance with article 5, paragraph 1, and the result is equally skewed towards the giving party. Age of marriage, children, and fault are the three key variables in this issue, and they are also the most powerful bargaining chips in negotiations.
