Criminal case
Acquittal case:
1. Case of Wu et al. involving the smuggling of ordinary goods. The Customs Anti-Smuggling Bureau determined that tax evasion amounted to nearly RMB 500,000 (under the statutory sentencing framework for this offense, tax evasion ranging from RMB 100,000 to RMB 500,000 is punishable by imprisonment of up to three years). During the investigation stage, through effective defense, we secured for Mr. Wu (an accomplice) the favorable circumstances of being an accomplice and making meritorious service, ultimately resulting in a decision not to prosecute (acquittal).
2. Case of Xiao Moumou for the crime of concealing or disguising proceeds from crime. The investigative authorities allege that Xiao’s bank account received RMB 84,986 in proceeds from fraud (for which the statutory penalty is imprisonment of up to three years, detention, or control). Intervened during the review and prosecution stage; following effective defense, the procuratorate determined that the facts of the crime were unclear and the evidence was insufficient, ultimately issuing a decision not to prosecute (acquittal).
3. Case of Liang Mou for the crime of smuggling goods whose import or export is prohibited by the state (smuggling frozen products case). The investigating authorities have charged Liang with organizing others to participate multiple times in the smuggling of frozen goods, with the value of the goods involved amounting to approximately RMB 6 million (for this offense, a statutory penalty of five years’ or more imprisonment applies when the value of the goods involved reaches RMB 6 million). Intervention during the investigation phase resulted in a not‑guilty decision by the procuratorate following effective defense.
4. Case of Li, who gathered a crowd to disrupt social order. The investigation organ determined that Li and many others gathered to disturb the law enforcement bureau entrusted by the Sanya municipal government to carry out the demolition work and injured four staff members. After accepting the entrustment, it believed that Li did not reach an agreement with the Sanya Municipal People's government on land expropriation compensation and had filed an administrative reconsideration. In the case of private benefit relief and did not constitute a crime. After communicating the facts of the case with the prosecutor, the party was released on bail 37 days after detention, after obtaining a decision not to prosecute (not guilty).
5. Case of Zhang refusing to pay wages. The investigation organ found that Zhang was still in arrears with migrant workers' wages of 930000 yuan after being ordered to pay by qionghai city Comprehensive Administrative Law Enforcement Bureau. During the investigation stage, he intervened and submitted to the procuratorate for approval of arrest. After communication, the case was transferred to the procuratorate for examination and prosecution. After effective defense, the case was returned to the public security organ for handling.
Cases of misdemeanors:
1. In the case of smuggling ordinary goods (purchasing and smuggling on behalf of others), more than 300 million yuan of tax evasion (fixed-term imprisonment of more than ten years) was involved in the investigation stage. The procuratorate recommended a fixed-term imprisonment of ten years. After effective defense in the first instance, the court adopted the defense opinions of accomplice and meritorious service, and finally sentenced to four and a half years in prison.
2. Case of smuggling ordinary goods involving Yao et al. (a case under the supervision of the General Administration of Customs’ Anti-Smuggling Bureau, and among the first batch of exotic pet smuggling cases in Hainan Province). The first-instance court found that over RMB 1.5 million in taxes had been evaded, and sentenced the defendant to three and a half years’ imprisonment and a fine of RMB 700,000. After intervening during the second-instance proceedings and conducting effective defense, the amount of evaded taxes was reduced to RMB 1.18 million, and the defendant was ultimately sentenced to three years’ imprisonment and a fine of RMB 500,000.
3. Long Mou's crime of smuggling ordinary goods (cross-border e-commerce smuggling). The Customs Anti-Smuggling Bureau determined that the individual committed a crime by evading over RMB 2.6 million in taxes (under the law, such offenses involving tax evasion of RMB 2.5 million or more are punishable by a fixed-term imprisonment of ten years or more). During the investigation phase, through effective defense, we successfully secured a determination that the case constituted corporate crime (for which the statutory penalty for evading tax amounts of RMB 10–50 million is imprisonment of three to ten years) and established the defendant’s status as having voluntarily surrendered. Ultimately, the court sentenced the defendant to three years and six months’ imprisonment.
4. Case involving Yang, who is suspected of the crime of producing and selling substandard products. The investigating authorities contend that, as the de facto person in charge of a certain company, Yang continued to manufacture fruit-flavored e-cigarettes in accordance with others’ instructions after the mandatory national standard for e-cigarettes came into effect on October 1, 2022. According to the authorities’ appraisal, the value of the e-cigarettes involved exceeds RMB 1.4 million (a statutory penalty of seven years’ imprisonment or more applies). We intervened during the investigation phase and, after multiple communications with the prosecutor, obtained agreement to determine the value of the case based on the actual transaction amount of RMB 180,000. Ultimately, the procuratorate recommended a sentence of one year and three months’ imprisonment, which the court accepted, resulting in the defendant serving the full term.
5. The case of smuggling ordinary goods involving Company A, Mr. Zhan, and Mr. Guo (the first batch of cigar-smuggling cases in Hainan Province). Intervened in the investigation stage, after effective defense, successfully won the unit crime, and reduced the tax to 900000 yuan (the legal penalty for the unit to evade tax 20-1 million yuan should be sentenced to fixed-term imprisonment of not more than 3 years). At the same time, Guo won the accessory plot and was finally sentenced to a fine of 500000 yuan; Zhan's fixed-term imprisonment of 1 year and 6 months, suspended for 2 years; Guo's fixed-term imprisonment, probation for one year.

7. Case of traffic accident involving Liang. The procuratorial organ determined that Liang drove a license‑plate‑less motorized tricycle while intoxicated and without a driver’s license, causing one death and one injury before fleeing the scene. It recommended a three‑year fixed‑term imprisonment; however, through effective defense, the defendant was granted a suspended sentence.
8. Case of Long’s crime of assisting in information network-related criminal activities. The amount of money involved in the case was more than 4 million. When the procuratorate told the procuratorate to change the crime to cover up and conceal the crime, it intervened (for example, the sentence for changing the crime would be adjusted to four to five years and a fine of 150000). After effective defense, it sought a suspended sentence for the defendant.
9. Case of Li et al. for the crime of smuggling ordinary goods and the crime of smuggling products made from precious animals (a case under the supervision of the General Administration of Customs’ Anti-Smuggling Bureau, and Hainan Province’s first case involving the smuggling of dried Chinese rat snakes). The Customs Anti-Smuggling Bureau has identified the client as the principal offender, responsible for evading approximately RMB 3 million in taxes (under the law, such evasion exceeding RMB 2.5 million is punishable by a fixed-term imprisonment of ten years or more). Additionally, the client smuggled 515 items of endangered animal products listed in the CITES Appendices, valued at over RMB 1.6 million (under the law, smuggling precious animals or their products valued between RMB 2 million and RMB 20 million is punishable by a fixed-term imprisonment of five to ten years).
